This certainly explains why the administration’sSolicitor General went to such great lengths in confusing us as to whether it was a tax or a fee. If they planned on using the reconciliation rule in the Senate to pass it at midnight on Christmas Eve, which Reid ultimately did do, Obamacare’s mandate had to be considered a fee and not a tax. This is why the Solicitor General was decidedly vague in answering any questions concerning it being a tax.
This is constitutionally a procedural open and shut case a al Roberts decision that it is clearly a tax. Obamacare is therefore unconstitutional in total because they did not follow the Constitution’s Origination Clause in making it.

But wait, if this case goes to the Supreme Court, one can count on Justice Roberts to rule that it is now a fee!!!!
