Judge rules White House showed “bad faith” in global-warming case

A federal court has ruled that the Obama White House was stonewalling in its refusal to turn over global warming documents requested under the Freedom of Information law

In this most recent case, the Competitive Enterprise Institute was trying to force the White House Office of Science and Technology Policy to release documents backing up Director John C. Holdren’s finding that global warming was making winters colder — a claim disputed by climate scientists. Mr. Holdren’s staffers first claimed they couldn’t find many documents, then tried to hide their release, saying they were all internal or were similar to what was already public.

But each of those claims turned out not to be true. “At some point, the government’s inconsistent representations about the scope and completeness of its searches must give way to the truth-seeking function of the adversarial process, including the tools available through discovery. This case has crossed that threshold,” the judge wrote.

The judge also ruled that they will now proceed with “discovery”, in which the courts will force the administration to release documents, under penalty of contempt.

The article also notes that this is the third time the courts have been forced to go this route with the Obama administration. For some reason, they seem to be stonewalling a lot of Freedom of Information requests. And that doesn’t even include the stonewalling the IRS did in the Lois Lerner IRS scandal.

    Of course if Hillary becomes Pres, the MSM will declare Obama’s the “Second most open…”

    Remember, even liberal law professor Laurence Tribe compared Obama to Nixon.

    It would be indeed. The only reason for stonewalling is not having the evidence to back up the claim. If it was true, it would’ve been headline news. Congress would have already passed cap and trade taxation, and coal fired power plants would be outlawed.
    The public can’t handle the truth. It is necessary for the government to protect the public from realizing that it has no clothes. As long as we continue to believe that we are free and happy squabbling over which bathroom we can use they will continue to run our country into the ground. (or into the pockets of their fellow cronies, banks, and foreign entanglements). To keep the public distracted, I wonder if bathroom 2.0 will be the discussion of if there are any privacy rights at all? if the transgender has the right to come into your home to use the bathroom. Discrimination, whether real or perceived, has no limits.

    I just got through reading 108 posts on the greening of planet earth. You guys are amazing, well thought out arguments and commentary trying to convince a stone to bleed. It is easier to drink the punch, then to admit that your Life long convictions and beliefs are wrong. Faith, I find, is stronger than facts and ones convictions can withstand an onslaught of data.
    For example, looking up some of the links, the one on skeptical science had me laughing out loud! It actually said that the second law of thermodynamics does not say that energy can’t flow from the cold to the hot??? Is the fire in my furnace going to start extracting heat from my home? It is one thing to have crazy and unproven theories, it’s quite another to rewrite the laws that govern energy and nature. Is the Supreme Court going to repeal the law of gravity because it discriminates against fat people?
    And why does the phrase “consensus of scientists” keep reappearing? This is a political term like democracy. Or a religious term like the Cardinals considering a new pope and coming to a consensus to send up the white smoke. If you have no factual data to consider, then all you have is an opinion based upon your background and experience. So how many angels can dance on the head of a pin? How large is the pinhead, how small are the Angels, and are they slow dancing or break dancing… I NEED DATA Can you imagine Rockets built by a show of hands on what method will work? Consensus to me means conmen dressed in white lab coats getting their story straight so they are stronger. They hang together or they will all hang separately.
    Real scientist show their work, and their methods. Other scientist will take their data home evaluate it, re-create it, and verify that it works independent of political, social, or cultural influence. I witnessed this process with ColdFusion. It failed the verification process miserably. The extra heat turned out to be hydrogen loaded in the water that continued to burn in the platinum sponge catalyst after the machine had been turned off.

    We need to establish the verified facts before we can consider the fantasies and the projections of computers. Saying “garbage in garbage out” is not enough. Here is an example I like: A new speed limit sign with built in camera was placed in a residential neighborhood. It clocked Volkswagen going 31 mph in a posted 30. Next day he was doing 32. Then 33. The computer did a 100 day forecast and determined that this Volkswagen would soon be doing 133 mph and issued an immediate arrest warrant to stop the future threat. Lives were at stake, and it was necessary to act now!… whose side do you take? The computer is correct, but the answer is not based in reality. And to make things worse, on the days the car travels 20 mph, due to playing children, it does not record because it’s only programmed to retrieve data from those going over the speed limit. The sample is flawed. When people at the Hague in Europe heard of this, the requested that this man stand trial for genocide and crimes against humanity… You see when they did a long range forecast they found out that in as little as six years, he would be going fast enough to achieve orbit and could be miss identified as a ballistic missile causing World War III and billions to die…
    This may sound silly, but even as we speak there are warmntologist declaring that climate deniers should be imprisoned for not believing! Remember, religious Heresy is determined by those who are in power and the steps they will do to keep it. The recent past and the millions dead for lesser reasons does not give me hope. All those who contribute to the exchange on this website does. Keep fighting for the truth and the truth will set you free…

    The Clinton Administration & the EPA were notorious delayers, referencing FOIA requests. (and in at least 1 instance, intentionally destroyed documents.)

    -Mark Levin, talk show host, also runs a legal Foundation, that has battled & won against the EPA (& Dept. of Education) using FOIA requests.

    “Landmark Legal Foundation today asked a federal judge to prevent the Environmental Protection Agency from destroying documents Landmark has sought in a Freedom of Information Act (FOIA) concerning a spate of new environmental regulations being promulgated by the EPA in the last days of the Clinton Administration.
    Original FOIA request for documents to EPA in 2000, Federal Judge finally cited the EPA for willful contempt in 2003.
    –If anyone recalls—(& this was revealed during “discovery,” Levin personally deposed the EPA adm.) it was demonstrated the EPA “intentionally destroyed data, hard-drives, and email,” despite an active FOIA request & document preservation-order in place.
    They were on a Regulation binge before Clinton left office & allegedly coordinated with NGO groups

    I should add, LandMark Legal Foundation also has multiple active FOIA requests & contempt cases, filed against the current Obama EPA. They were granted ‘discovery’ in 1 instance & that case is slowly proceeding forward.
    –The pattern of the “most open administration in history,’ appears to be delay, delay, delay.
