Justice Department to give House all “Fast & Furious” documents

Chickens coming home to roost? The Trump Justice Department has agreed to provide the House Oversight and Government Reform Committee all the “Fast & Furious” documents that the Obama administration had refused to provided.

In June 2012, the House of Representatives voted to hold then-Attorney General Eric Holder in contempt for refusing to turn over certain documents related to the botched sting, which he dismissed as “politically motivated.” The House also approved a civil measure against the attorney general, which allowed the House Oversight Committee to eventually file a lawsuit against Holder over his failure to produce the subpoenaed documents. That lawsuit was filed in U.S. District Court in Washington in August 2012.

Now, it appears that six-year long court battle is coming to an end. “The Department of Justice under my watch is committed to transparency and the rule of law. This settlement agreement is an important step to make sure that the public finally receives all the facts related to Operation Fast and Furious,” Attorney General Jeff Sessions said in a statement Wednesday.

Why does the House want these documents? And why did Eric Holder stonewall them?

Operation Fast and Furious took place from late 2009 to early 2011 when the Phoenix Field division of the Bureau of Alcohol, Tobacco, Firearms and Explosives allowed the illegal gun sales of nearly 2,000 firearms with the intent to track the sellers and buyers, believed to be part of Mexican drug cartels.

Two of the weapons linked to the operation were later recovered near the scene of a December 2010 shootout where U.S. Border Patrol Agent Brian Terry was killed. This, plus whistleblowing, caused the Senate Judiciary Committee and the House Oversight and Government Reform Committee to open investigations into the botched operation. [emphasis mine]

This was the first Obama scandal, and at any other time in our history, would have brought him down. Imagine, an administration is purposely allowing illegal guns sales, in large numbers, and then failing to properly track those illegal guns as they move into Mexico to be used by the drug cartels.

In our time, however, the partisan mainstream press is only interested in stories that make Democrats look good, or Republicans look bad. It is shameful, and disgusts me, as a journalist.

To be confirmed by the Senate, attorney general nominee Loretta Lynch only needs four Republicans to support her nomination. But it is unclear where those votes will come from. Sen. Orrin Hatch (Utah) is the only Republican so far who has signaled his intention to vote for Lynch, though several others have spoken favorably about her.

Holder’s order applies only to “adoption,” which happens when a state or local agency seizes property on its own and then asks the Justice Department to pursue forfeiture under federal law. “Over the last six years,” the DOJ says in the press release announcing Holder’s new policy, “adoptions accounted for roughly three percent of the value of forfeitures in the Department of Justice Asset Forfeiture Program.” By comparison, the program’s reports to Congress indicate that “equitable sharing” payments to state and local agencies accounted for about 22 percent of total deposits during those six years. That means adoptions, which the DOJ says represented about 3 percent of deposits, accounted for less than 14 percent of equitable sharing. In other words, something like 86 percent of the loot that state and local law enforcement agencies receive through federal forfeitures will be unaffected by Holder’s new policy.

The story also notes how the press, especially the Washington Post which led with this story, teamed up with Holder to overstate the impact Holder’s order would have.

Holder’s action is still in the right direction. He just didn’t go very far, which makes perfect sense considering the generally corrupt and oppressive nature of the Justice Department since he took it over. Initially I thought pigs were flying by his announcement. Now I know they can’t.

Holder bars use of federal law to seize private property

Good news: Attorney General Eric Holder on Friday barred state and local police from using federal law to seize any private property unless an actual crime is being committed.

Holder’s decision allows some limited exceptions, including illegal firearms, ammunition, explosives and property associated with child pornography, a small fraction of the total. This would eliminate virtually all cash and vehicle seizures made by local and state police from the program. While police can continue to make seizures under their own state laws, the federal program was easy to use and required most of the proceeds from the seizures to go to local and state police departments. Many states require seized proceeds to go into the general fund.

A Justice official, who spoke on the condition of anonymity in order to discuss the attorney general’s motivation, said Holder “also believes that the new policy will eliminate any possibility that the adoption process might unintentionally incentivize unnecessary stops and seizures.”

As much as I think Holder has been a dishonest and corrupt attorney general who has used his power to attack his political opponents, this decision by him should be lauded highly. It was the right thing to do.

The Holder Justice Department is under legal attack from several fronts. Holder’s effort to block all investigations, from Fast and Furious to the IRS scandal, will be revealed quite soon in court, and when it does, he is going to be toast. Better he leave now then be forced to resign at a time not of his choice. As Morrissey notes,

Resigning now allows Obama to appoint a replacement soon, and Senate Democrats to schedule the hearings during the lame-duck session (and don’t forget Harry Reid’s rule change on filibusters for presidential appointments, too, which expires at the end of this session).

Holder’s real goal? Make the law less inconvenient so he and others in power can wield more power over everyone else. That goal is also shared by Obama as well as a large percentage of the politicians in DC from both parties. After discovering a “suspicious package,” the Secret Service ended the protest. “Several agents seemed hostile to our march and seemed anxious for us to leave the area,” Maurice Lewis, a University of California student, told Campus Reform. “The discover[y of] the ‘unidentified package’ came just as the protest began gain traction.”

Not only should Holder be fired, so should Obama, for allowing this. And Romney should announce that he plans to investigate the Secret Service and fire them if this “suspicious package” report turns out to be false.

This evidence provides an explanation why Obama, Holder and other Justice officials have been stonewalling Congressional investigations. The documents they are withholding likely prove that they have been lying, from the beginning, about what they knew about Fast-and-Furious. Worse, their willingness to let guns pass over the border into Mexico illegally would make them accessories in the murders of Terry and numerous Mexicans.

Imagine a government agency designed for the specific purpose of investigating and preventing the unlawful use, manufacture, and possession of firearms. Now imagine this agency engaging in an operation that not only goes against that purpose, but actually seeks to accomplish the opposite, by actively encouraging the sale of firearms to people whose ties to organized crime and gun violence are well known – and that this operation involves sending firearms across an international border into a country that this agency, and the government of which it is a part, purposely failed to warn, inform, or request permission from.

Meanwhile, on the same day that the President invoked executive privilege to avoid giving Congress emails and documents concerning the Fast-and-Furious gunrunning scandal, the Attorney General admitted lying in his testimony to a House committee, and that same committee voted to hold the Attorney General in contempt, ABC News has as its lead story … the heat wave in the northeast.

As I’ve said many times before, if you depend on television news to find out what’s going in the world, you’re not merely uninformed, you are misinformed.

The Justice Department has retracted a second statement made to the Senate Judiciary Committee. During a hearing last week, Attorney General Eric Holder claimed that his predecessor, then-Attorney General Michael Mukasey, had been briefed about gunwalking in Operation Wide Receiver. Now, the Department is retracting that statement and claiming Holder “inadvertently” made that claim to the Committee.

In other words, Holder has now admitted that he lied when he was testifying to Congress.

The state is enforcing the law, as written on the books. Yet Eric Holder’s Justice Department somehow thinks that this is illegal. Maybe someone should teach Holder and his attorneys how to read.

In related news, Holder’s Justice Department is suing a Las Vegas casino because the casino followed the law in verifying that all its employees were legal residents of the United States.

The sitting governor of the U.S. Virgin Islands, his attorney general and an unspecified number of Virgin Islands legislators also accepted bribes, the source said, adding that U.S. Attorney General Eric Holder is aware prosecutors and elected officials were bribed and otherwise compromised, but has not held anyone accountable.

I must point out that a certain skepticism is called for: This story is very vague about who, what, when, and where, and its sources are anonymous. Nonetheless, if true this might very well be the bombshell story that ends Eric Holder’s career. What it does to the Obama administration remains to be seen.

Mr. Cunningham is a Department of Justice lawyer. The “Department” is the Department of Justice itself. And “Fast and Furious” was the Obama administration’s project to allow about 2000 guns to be smuggled illegally into Mexico, for reasons that remain inexplicable.

Though Cunningham has the right to take the fifth, it should immediately disqualify him from his job, and the Obama administration should fire him. That they don’t tells us a lot about their own culpability in the Fast and Furious gun smuggling scandal. As Issa wrote in his letter to Eric Holder on Tuesday,

Mr. Cunningham’s broad assertion of his Fifth Amendment privilege raises the specter that the Department has allowed him to continue in his position as Chief of the Criminal Division knowing that he might have criminal culpability himself.

“Department of Justice officials have reported to the Committee that my client relayed inaccurate information to the Department upon which it relied in preparing its initial response to Congress. If, as you claim, Department officials have blamed my client, they have blamed him unfairly,” the letter to Issa says. Romero claims Cunningham did nothing wrong and acted in good faith, but the Department of Justice in Washington is making him the fall guy, claiming he failed to accurately provide the Oversight Committee with information on the execution of Fast and Furious.

In other words, give me immunity and I will fry Eric Holder and the Obama administration.
