NIH workers vote to form union

What could possibly go wrong? The newest workers at the National Institutes of Health (NIH) have now voted overwhelmingly to unionize, thus shifting power from research to workers’ rights.

Hundreds of early-career researchers at the US National Institutes of Health (NIH) have voted overwhelmingly to form a union, nearly completing the official process required to do so. They plan to call on the agency — the world’s largest public funder of biomedical research — to improve pay and working conditions, and to bolster its policies and procedures for dealing with harassment and excessive workloads.

About 98% of the research fellows who participated in the ballot voted on 6 December to form the union, with 1,601 voting in favour and just 36 against. Barring any objections, the result will be certified by the US Federal Labor Relations Authority (FLRA) after five business days, and the union will become the first ever to represent fellows at a federal research agency and the largest union to form in the US government in more than a decade.

Routinely these government unions have been a disaster for both the taxpayer and the work the agency does. The focus becomes pay instead of doing the job. And because it is a government operation, politics always plays a hand. In most cases the government works hand-in-glove with the union. The union donates money to the politician’s campaign coffers, the politician then passes legislation favoring the union or the pay scales.

We have seen this disaster most horribly in our public schools. During and after the Wuhan panic the unions have consistently fought to keep schools closed, pushing remote teaching so that the teachers can stay home, not teach, while still getting paid. Before COVID the unions forced high wages and low standards, which has resulted in kids leaving schools badly educated at great cost.

It should be noted that the existence of these federal government unions began with a presidential executive order by John Kennedy in the early 1960s that a future president has the ability to cancel. One wonders if such a thing might happen in the future.

In the meantime, expect research coming out of the NIH to continue to go downhill.

“Segregation today, segregation tomorrow, segregation forever!” According to clauses in a new union contract in Minneeapolis, white teachers must be laid off or reassigned first should a layoff be required, and that “educators of color” will be exempt from such layoffs.

“Starting with the Spring 2023 Budget Tie-Out Cycle, if excessing a teacher who is a member of a population underrepresented among licensed teachers in the site, the District shall excess the next least senior teacher, who is not a member of an underrepresented population,” the agreement reads.

According to the United Federation of Teachers, “excessing” means “reducing staff in a particular school when there is a reduction in the number of available positions in a title or license area in that school.”

The agreement adds that non-white teachers, as well as those working in various programs, “may be exempted from district-wide layoff[s] outside seniority order.” The agreement also prioritizes the reinstatement of teachers from “underrepresented populations” over white teachers.

Bring a gun to a knife fight: Charlene Carter, a flight attendant who had worked at Southwest Airlines for 20 years but was fired in 2017 because she had publicly opposed the use of her union dues to fund pro-abortion protests, has now won a $5.1 million lawsuit against both Southwest and her union.

A jury in a Dallas federal district court handed down the verdict, ruling Charlene Carter had been fired for her religious stance on abortion, which she shared to social media, and that her termination was in violation of her right to advocate against her union.

If it stands, Carter could collect $4.15 million from Southwest and $950,000 from Local 556 of the Transport Workers Union, mostly in punitive damages.

The leftist losing streak continues: The Supreme Court today ruled that government employees cannot be forced to pay dues to government unions.

The court’s conservative majority scrapped a 41-year-old decision that had allowed states to require that public employees pay some fees to unions that represent them, even if the workers choose not to join.

The 5-4 decision fulfills a longtime wish of conservatives to get rid of the so-called fair share fees that non-members pay to unions in roughly two dozen states. Organized labor is a key Democratic constituency.

The court ruled that the laws violate the First Amendment by compelling workers to support unions they may disagree with. “States and public-sector unions may no longer extract agency fees from nonconsenting employees,” Justice Samuel Alito said in his majority opinion in the latest case in which Justice Neil Gorsuch, an appointee of President Donald Trump, provided a key fifth vote for a conservative outcome.

Since government workers tend to be leftist anyway, especially in the federal government, I don’t expect this ruling to impact their fund-raising that much, initially. Over time, however, the unions are going to see their power recede as more and more employees decide they don’t need, or want, the unions.

VA reinstates worker who committed armed robbery

Our government at work: A VA worker has been reinstated with back pay after being fired for participating in an armed robbery.

It is worse than you think. The reason her union won her case was because the VA hadn’t fired other workers who had broken the law, so thus it was unfair to fire her as well.

A Department of Veterans Affairs employee in Puerto Rico was fired after being arrested for armed robbery, but her union quickly got her reinstated — despite a guilty plea — by pointing out that management’s labor relations negotiator is a registered sex offender, and the hospital’s director was once arrested and found with painkiller drugs…

Employees said the union demanded her job back and pointed out that Tito Santiago Martinez, the management-side labor relations specialist in Puerto Rico, who is in charge of dealing with the union and employee discipline, is a convicted sex offender. Martinez reportedly disclosed his conviction to the hospital and VA hired him anyway, reasoning that “there’s no children in [the hospital], so they figure I could not harm anyone here.”

The union’s position — that another employee committed a crime and got away with it, so this one should, too — has been upheld by the highest civil service rules arbiters, and has created a vicious Catch-22 where the department’s prior indefensible inaction against bad employees has handcuffed it from taking action now against other scofflaws.

And the intellectual elites in Washington wonder why people are angry and want to throw the bums out. In fact, that they remain clueless about this anger and continue to do nothing about this kind of obscene corruption in the government departments that they control is only more reason to throw them out. Maybe we should even consider bringing back that old American custom: to tar and feather them and ride them out of town on a rail.

[The reason unions fought Scott Walker’s reforms so hard] wasn’t because they were worried about employees as much as they were worried about losing political clout, earned mainly through forced contributions and closed shops. They used that money not so much to improve the lives of public-sector employees, but to hand-pick their bosses, who would also be their negotiating partners. Now that their cash flow has become so greatly restricted — and will likely become even more so — they have to focus on delivering value to members or watch them walk away. That’s exactly how it should have been all along.

Union officials declined to release precise membership data but confirmed in interviews that enrollment is dramatically lower since the new law was signed in 2011. The state branch of the National Education Association, once 100,000 strong, has seen its membership drop by a third. The American Federation of Teachers, which organized in the college system, saw a 50 percent decline. The 70,000-person membership in the state employees union has fallen by 70 percent.

The bottom line is that the use of force is almost always wrong, whether it is forcing people to join unions or forcing florists to participate in gay weddings. Forcing public employees to be union members didn’t so much improve their wages as much as encourage corruption in the public sector while simultaneously screwing the taxpayer.

Unions discover Obamacare sucks

Finding out what’s in it: Because of required Obamacare regulations and taxes on their union health plans, the unions representing workers at 29 west coast commercial ports are now threatening to strike and shut the ports down.

Obamacare imposes a 40 percent tax on health benefits deemed too generous by the government. Health benefits exceeding $10,200 a year in value for individuals or $27,500 for families are defined as “Cadillac” plans and are subject to the tax. Health benefits for longshoremen exceed $40,000 per employee, meaning the union would be served an enormous tax bill when the penalty is imposed in 2018. The longshoremen’s contract expired in July, 2014 and contract talks have stalled, in large part, over whether workers or employers will pay the new Obamacare tax.

But hey, these unions voted for and continue to support the Democratic Party without question, even as the Democratic Party continues to block any repeal or changes to Obamacare. To these union leaders, it all must be Bush’s fault!

Obamacare forces actors’ union to drop older members from healthplan

Finding out what’s in it: Actors’ Equity Association, the union for stage actors, is dumping its older members from its health insurance plan because of the rising costs of Obamacare.

I guarantee to you that more than 80 percent of the members of this union voted for Obama and support Democratic policies blindly. Now those policies are blind-siding them cruelly, as this quote from the article demonstrates:

“They keep saying there’s a comparable Obamacare option, but there’s not,” one actor said. “I won’t be able to afford to go to [my doctor] anymore.”

Will these liberal actors change their votes? I am pessimistic. From the late seventies to the mid-nineties I worked in the movie industry, and during that time I observed a strong hostility and close-mindedness among this community for any political ideas not labeled “Democratic.” They are the most partisan people I have ever met, and will probably carry that partisanship to their graves — which is likely to happen sooner now that Obamacare is there to “help” them.

Finding out what’s in it: Teachers in Reynoldsburg, Ohio have announced that they will go on strike rather than accept a school contract offer that takes them off employer health insurance and forces them onto Obamacare.

The school board says it wants to give cash payments to teachers to buy their own health insurance on the “new state insurance market.” Ohio did not set up a state exchange which means teachers would need to purchase their insurance through the federal exchange under this plan.

That federal exchange is Obamacare.

The comments at the link are entertaining, as they all recognize the irony of this story: These teachers and this union almost certainly supported Obamacare and Obama. They did it brainlessly, for partisan reasons, without considering for one second the real life consequences of the law their Democratic lords were writing and passing, consequences that conservatives desperately tried to explain to them. Now they have to live with it, and they don’t like it.

The sad part of this, however, is that you can safely rely on them to still vote Democrat in the next election. If you are brainless once, what will make you have a brain later?

Lerner ignored questionable union political activities

Working for the Democratic Party: Newly released emails show that Lois Lerner once dismissed complaints that labor unions were not reporting to the IRS millions of dollars in political activities — almost all of which helped Democrats — that they did report to the Labor Department.

In 2006, the year leading up to Lerner’s email, the national headquarters for the AFL-CIO reported no direct or indirect political expenditures with the IRS on their 990 form, leaving the line 81a blank. That same year, the AFL-CIO reported $29,585,661 in political activities with the Department of Labor. Also in 2006 the Teamsters Union reported no political expenditures with the IRS while at the same time reporting $7,081,965 with the Labor Department. Again in 2006, Unite-Here reported no political activity with the IRS and $1,451,002 with the Labor Department. In 2005, the National Education Association also reported no political expenditures with the IRS while at the same time reporting $24,985,250 with the Labor Department.

The lack of reporting to the IRS was essentially illegal. Yet, when complaints were made to Lerner about this, she poo-pooed the issue and apparently squelched further investigations.

“This successful vote will allow us to work with management to improve working conditions for NASA support and administrative staff here at NASA headquarters, thereby improving operations, saving money, and retaining an engaged and professional workforce,” said Tifarah Thomas, a program specialist within NASA’s Office of the Chief Health & Medical Officer. Professional support specialists at NASA headquarters include budget analysts, policy analysts, administrative specialists, secretaries, and others.

NHPA currently represents nearly 200 engineers and scientists at NASA in Washington. The combined unit, including the professional support specialists who voted today for IFPTE representation, will now represent more than 500 workers at the headquarters of America’s space agency. IFPTE also represents engineers and scientists at NASA labs and research facilities from coast-to-coast.

Anyone with the slightest objectivity knows that the working conditions for federal employees in Washington is glorious, with pay about double what everyone else in the country makes and benefits far exceeding even the best private packages. In addition, the hours are great and just slightly longer than what my generation would have called bankers’ hours. Moreover, if I can be blunt, these engineers are mostly paper pushers. They are not the one’s designing and building anything that might fly in space. Their only reason to unionize now is because they see a threat to their cushy jobs with the advent of private space and are organizing to secure their unneeded positions.

While spending has just about tripled in inflation-adjusted dollars and the number of school employees has almost doubled since 1970, reading, math and science scores for students have remained stagnant.

“That is remarkably unusual,” Coulson wrote in his study. “In virtually every other field, productivity has risen over this period thanks to the adoption of countless technological advances — advances that, in many cases, would seem ideally suited to facilitating learning. And yet, surrounded by this torrent of progress, education has remained anchored to the riverbed, watching the rest of the world rush past it.”

Click on the link just to see the main graph. While math, reading, and science scores have remained unchanged for literally decades, spending has skyrocketed. To put it bluntly, we aren’t getting our money’s worth.

Union head Donald “D.” Taylor, in a note also being sent to Congress, demands changes and admits to being reluctant to bash a president his union supported. “Believe me; I enter this entire debate about the consequences of the ACA with a deep reluctance,” he wrote. “Unite Here was the first union to endorse then-Senator Obama. We support the addition of health care to millions of Americans. Yet facts are facts, and Obamacare will cost our members the equivalent of a significant pay cut to keep their hard-won benefits.”

In other words, he is a blind partisan fool. His partisanship is so strong that even now he is reluctant to attack the President or the Democrats for creating and forcing Obamacare on us. He also is so partisan that when they were writing the bill he accepted blindly what they were telling him and thus didn’t bother to read the law himself. Then again, he really didn’t have to read it, all he really had to do was listen to just a handful of conservative thinkers who were saying then that Obamacare would “reduce wages, cut hours, and limit access to health insurance.”

The most shameful part of this whole thing is that come the next election, this union chief and his union will almost certainly still back the Democrats blindly.

On Feb. 20, thousands of housekeepers, porters, cooks, cocktail servers, and others represented by Nevada’s largest union, the Culinary Union Local 226, voted to end a contract extension the workers agreed to last summer. The union wants to maintain its current benefits — including health care coverage at no cost to workers, pensions, and guaranteed 40-hour workweeks.

Rising health care costs due to provisions in the Affordable Care Act could put those benefits in jeopardy, the union says.

I bet that most of these workers voted for Obama and Harry Reid. I also bet that most of them will continue to do so, despite the obvious policy failures imposed on them by these Democratic politicians.

When they and Democratic legislators failed to prevent passage of Act 10 [the law that defanged the unions], they tried to defeat — with a scurrilous smear campaign that backfired — an elected state Supreme Court justice. They hoped that changing the court’s composition would get Walker’s reforms overturned. When this failed, they tried to capture the state Senate by recalling six Republican senators. When this failed, they tried to recall Walker. On the night that failed — he won with a larger margin than he had received when elected 19 months earlier — he resisted the temptation to proclaim, “This is what democracy looks like!”

It shows us how far we have fallen that we are surprised that the Obama administration is going to follow the law, as written and passed by Congress, rather than arbitrarily rewrite that law illegally into order to help its political allies. Nowadays we are increasingly expecting this administration to treat the law as a plaything that it can ignore willy-nilly, without any opposition from anyone.

This story also illustrates the danger of blindly supporting the actions of one political party. Union leaders have for decades allied themselves with the Democratic Party, without ever really questioning the wisdom of anything those Democrats were doing. Obamacare was only one example of this foolishness. Now they are going to suffer badly for their blind partisanship.

It would have been much smarter for those unions to have done what conservatives and tea party advocates demanded back in 2009 and 2010: Read the damn law before you pass it!

One of LGS’s contract workers recalled a union heckler telling them to “take your country ass back to Mississippi,” and “get your dumb Tennessee ass off that piece of equipment.” “What they would say is, ‘It sure would be sad if your trucks caught on fire,’” recalled the LGS worker, who spoke to TheDC News Foundation on condition of anonymity because the union also made threats against his wife and children.

Local 138 vice president Phil Capobianco made the threats, said the source. “[He] called and said, ‘Look you have to get us involved,’” recalled the source. “I said, first of all, I don’t have to; second of all, we’ve tried; and third you’ve said you refuse to work for the rates we can pay.” Then Capobianco said something that the source would never forget. “He said, ‘I would just hate for anything to happen,’” recalled the source. Capobianco then rattled off a list of the source’s home address, his wife’s name, his kids and their current whereabouts.

“I’m a combat veteran, and I have never in my life been as frightened as I was in that phone call when he started naming my family members and where they were and what they were doing,” recalled the source. “From that point forward I wasn’t polite to him. I told him exactly what he could do with himself, what he could do with his union, and what he could do with his threats.”

The kids took to their social media of choice, Facebook, condemning the teacher’s union with harsh, sometimes obscene, language. On the afternoon they were supposed to report to the school library instead of the band room, they staged a mass sit-in on the concrete steps that led to the band room. The local newspaper went wild with letters of complaint from parents and community members.

The union reps went on damage control. Their goal, they insisted, was not to hurt the kids. They told the local volunteer choir director, whose class they had also forced into cancellation, that they did it “for the good of the kids,” arguing that only credentialed teachers should be allowed to teach children.

But here’s where this sad saga turns more sensible. [emphasis mine]

I want to note the anger the teenagers felt toward the union. Seems the union kinda shot itself in the foot. These kids will think badly of unions for the rest of their lives.

Many UFCW members have what are known as multi-employer or Taft-Hartley plans. According to the administration’s analysis of the Affordable Care Act, the law does not provide tax subsidies for the roughly 20 million people covered by the plans. Union officials argue that interpretation could force their members to change their insurance and accept more expensive and perhaps worse coverage in the state-run exchanges.

Our Union and its members have supported President Obama and his Administration for both of his terms in office.

But regrettably, our concerns over certain provisions in the ACA have not been addressed, or in some instances, totally ignored. In the rush to achieve its passage, many of the Act’s provisions were not fully conceived, resulting in unintended consequences that are inconsistent with the promise that those who were satisfied with their employer sponsored coverage could keep it.

These provisions jeopardize our multi-employer health plans, have the potential to cause a loss of work for our members, create an unfair bidding advantage for those contractors who do not provide health coverage to their workers, and in the worst case, may cause our members and their families to lose the benefits they currently enjoy as participants in multi-employer health plans.

But don’t worry, come the next election this same union will continue to support the same Democratic politicians that gave us Obamacare, because party partisanship is far more important than common sense and rational leadership.
