I listened a bit to Lawrence Tribe being interviewed today, one of the subjects that came up was Obamacare. Mr. Tribes position, if I understood it correctly, was that if the government offers the states something through a law and it turns out that the law is un Constitutional than it would be a miss carriage of justice and would be un Constitutional or unfair after it has been enacted and was running in those states to terminate it.

That surprised me, so if I understand it correctly the government can create something that they want to force on the people that is un Constitutional in Mr. Tribes estimation, in this example Obamacare, and if it has been running and people have been able to use it then it should remain unchallenged and in place.

Am I missing something here? I think I heard him correctly.
