Judge holds Interior Department in contempt over offshore oil drilling moratorium

A Louisiana judge has held the Interior Department in contempt over its offshore oil drilling moratorium. Key quote:

After [the judge] overturned the government’s moratorium in June, the agency issued a second nearly identical suspension. “Such dismissive conduct, viewed in tandem with the re-imposition of a second blanket and substantively identical moratorium and in light of the national importance of this case, provide this court with clear and convincing evidence of the government’s contempt of this court’s preliminary injunction order.”

The Obama administration might not realize it — as well as many politicians from both parties in DC — we are a nation of laws, not men. It thumb your nose at the law it will eventually come back to bite you. Especially if the citizenry becomes outraged at your arrogance.

White House arbitrarily gives healthcare law waivers to some companies

The law for some but not for others: Threatened with a firestorm of protest just prior to the election because a number of large corporations were going to drop millions from healthcare coverage because of the new Obamacare regulations, the White House today arbitrarily waived for one year those provisions for 30 large companies.

This action raises three obvious points:

  • If the healthcare law was so wonderful, why is the White House suspending its inception?
  • Why should these companies get a break, and not others? In fact, if I was the owner of a company that did not get a waiver, I would sue.
  • This once again proves false the claim by Obama that the law would force no one to lose their healthcare plan. To me, the words “You lie!” come quickly to mind.

The law and Obama at Yucca Mountain

Apropos to the space war between Obama and Congress over the Obama administration’s willingness to ignore Congressional legislation mandating the continuing funding of the Constellation program is this story about the administration’s efforts to circumvent federal law in order to cancel the use of Yucca Mountain in Nevada as a nuclear waste site. The courts have now expressly ruled [pdf] that the Obama administration it cannot do this: the law is the law, and they have to follow it. The key quote from the legal decision:

Unless Congress directs otherwise, [the Department of Energy] may not single-handedly derail the legislated decisionmaking process.

What a concept: the President and his appointees must obey the law!
