A newly released 2013 email from Lois Lerner reveals that she made a conscience effort to hide what she was doing from Congressional investigators.

Realizing that her emails at that time were being saved in some manner (this is long after her computer crash that supposedly destroyed her correspondence from 2011), she writes “we need to be cautious about what we say in emails”.

Really? Is that what an honest government worker does? I don’t think so.

Update: This good analysis of these new revelations notes that her email comment above was made only about six weeks before she took the fifth in House hearings. How interesting.

What are the odds of seven hard drives failing at the IRS? These are the odds: 78 billion to 1.

Of course, that number doesn’t include the fact that the seven failed hard drives just happened to belong to seven key figures in the IRS scandal and no one else, and that all seven failures apparently covered the key period of time when the harassment of conservative opponents to Obama and the Democrats was at its height.

But then, there’s “not a smidgeon of corruption” at the IRS or in Obama’s White House. Obama says so, and obviously we must believe everything he says.

An outraged Issa insisted that Americans should be able to know “they’re being honestly treated by your employees, especially somebody at such a high level. Isn’t that in fact a priority that should have allowed for full retention?”

“If we had the right resources, there would be a lot of priorities,” Koskinen shot back.

“So the American people should believe that if they don’t have the resources to pay their taxes, they shouldn’t pay their taxes,” Issa jabbed, “because if the IRS doesn’t have the resources, it won’t keep records? That’s pretty much what you’re telling us here tonight, is that resources are a question of whether or not you retain key documents.”

When Tennessee Republican Rep Scott DesJarlais asked Koskinen how much money it would take to replace the IRS’s computer systems in order to prevent another major data loss, he answered that it would cost between $10 and $30 million. In a tense moment, DesJarlais then reminded him that the IRS paid $89 million in bonuses last year, including $1 million to agency employees who owed back taxes.

Be sure the watch all the videos at the link. If you do and you still believe John Koskinen is telling the truth and is not a political thug who is doing the bidding of the White House to cover-up its use of the IRS to harass its political opponents, then you are probably so naive you believe Nigerian emails.

Lois Lerner’s computer allegedly crashed in June 2011, just ten days after House Ways and Means Committee chairman Rep. Dave Camp first wrote a letter asking if the IRS was engaging in targeting of nonprofit groups. Two months later, Sonasoft’s contract ended and the IRS gave its email-archiving contractor the boot.

IRS official and frequent White House visitor Nikole Flax allegedly suffered her own computer crash in December 2011, three months after the IRS ended its relationship with Sonasoft.

The timing is too perfect for anything but a cover-up. They were blatantly working for Obama’s campaign and the Democratic Party, and realized they needed to destroy the documents that proved that fact.

Here’s another tidbit about Lois Lerner’s lost emails: Her hard drive crashed ten days after the chairman of the House Ways & Means committee sent a letter to the IRS asking the agency if it was engaged in targeting.

What a coincidence! She discovers that Congress is interested in what she has been doing and suddenly her hard drive crashes, destroying all the emails she has written about this very subject. Do you smell a rat?

In addition, Congress last week discovered through other subpoenaed emails that Lerner was having conversations at that time with Department of Justice prosecutors about investigating conservative nonprofits. The evidence thus continues to suggest strongly that the White House was intimately involved in the decision use the IRS to harass its conservative opponents.

The quote comes from a House hearing today where lawmakers blasted the head of the IRS for claiming it has lost two years worth of Lois Lerner’s emails.

Update: I think it worthwhile to include video of this exchange between Paul Ryan (R-Wisconsin) and IRS Commissioner John Koskinen. The arrogance of Koskinen is, to use Ryan’s world, unbelievable.

I have been traveling so I missed posting the original story about this absurd claim by the IRS. It is a downright lie and a coverup and should be answered with prosecutions and imprisonment.

Republican lawmakers have been demanding the documents for months and, in March, Oversight Committee chairman Darrell Issa threatened to hold IRS commissioner John Koskinen in contempt if he did not produce the e-mails requested by the committee. Koskinen had told lawmakers it might take years to produce them. [emphasis mine]

Years, eh? That’s suddenly changed, hasn’t it?

The new more sinister IRS scandal.

Yesterday was a significant day in the IRS abuse scandal. The scandal evolved from being about pesky delays in IRS exemption applications to a government conniving with outside interests to put political opponents in prison.

Emails obtained by Judicial Watch through the Freedom of Information Act reveal Lois Lerner cooking up plans with Justice Department officials to talk about ways to criminally charge conservative groups that are insufficiently quiet.

Larry Noble, a law professor now with the Soros-funded Campaign Legal Center, was cited in the emails as someone agitating to jail conservatives who “falsely” report on IRS forms that they are not engaged in political speech. Lerner talked about setting up meetings with Justice Department election lawyers who wanted to talk about making Noble’s dreams a reality — this after Senator Sheldon Whitehouse raised the idea of criminal charges for conservatives who are not sufficiently quiet, charges that they falsely completed an IRS tax exemption form. [emphasis mine]

It might be illegal to claim tax exemption for non-political activities and then use that tax exemption to do politics, but it has to be emphasized that this law was only going to be used against those who disagreed with Obama and the Democrats. In other words, the IRS and the Obama administration weren’t really enforcing the law, they were thinking of using the law to put their opponents in prison.

This article does an excellent job of connecting the dots, both in terms of who and when, based on what we now know, from solid evidence. The author’s conclusion:

We now have a sitting Democrat congressman, Elijah Cummings, a sitting Democrat senator, Sheldon Whitehouse, the Federal Elections Commission, the U.S. Department of Justice, and the Internal Revenue Service all implicated in the scandal. Flax’s involvement puts the abuse squarely into the IRS commissioner’s office. But it takes an entity above all of those agencies to coordinate their actions. That entity can only be the White House.

Flax worked for the head of the IRS at the time, proving once again that this harassment was not instigated by “low-level employees in Cincinnati”, as claimed by Lois Lerner.

The evidence also shows that she was aggressively working for the Democratic Party, using her power as an important IRS official to bend the tax laws to attack that party’s political opponents.

She took the fifth in her first appearance, while also making a statement announcing her innocence. According to numerous experts, this statement voided her ability to take the fifth. There might or might not be fireworks on March 5, when she has been called to return, as she will likely do nothing but cite the fifth amendment in her answers. How the congressmen respond to her non-answers will be interesting.

An IRS official blasted Lois Lerner for her attempt to blame the agency’s targeting scandal on low-level employees in Cincinnati, according to newly released emails. “Cincinnati wasn’t publicly ‘thrown under the bus’ (but) instead was hit by a convoy of Mack trucks,” wrote Cindy Thomas, former director of the IRS exempt organizations office in Cincinnati, in a May 10, 2013 email to Lerner obtained by the House Ways and Means Committee.

Thomas wrote the email on the very day that the IRS targeting scandal broke when Lerner, a senior agency official based in Washington, D.C., admitted that her exempt organizations division engaged in improper targeting of conservative groups.

The truth was that the low-level employees in Cincinnati were getting their orders to harass conservatives from high up the chain in Washington.

A conservative government watchdog says it has obtained emails revealing that the Internal Revenue Service sent conservative groups’ private tax exemption application and tax return information to the Federal Elections Commission, in violation of federal law.

According to Judicial Watch, the emails from Jan. 2009 to the present, provided by the FEC in response to an August 2013 Freedom of Information Act request, yielded a “revealing email chain” between former Internal Revenue Services (IRS) Director of Exempt Organizations Lois Lerner and enforcement attorneys at the Federal Election Commission (FEC).

“[W]e have uncovered a troubling pattern of IRS officials sending official documents to non-official email accounts as well as the use of non-official email accounts to conduct official business,” the September 30th letter to acting IRS Commissioner Dan Werfil reads. “In some instances, IRS officials have sent taxpayer protected information to non-official email accounts.” The officials were identified as then-IRS Commissioner Doug Shulman, Lois Lerner, who headed the office at the center of the scandal, Judith Kindall, and Nikole Flax, who worked in Lerner’s office.

In the letter to Werfil, Issa said that the committee had found over 1,600 pages of emails and documents related to official business in non-official email accounts. Nearly 30 pages of the material contained confidential tax information. The revelation raises serious questions about privacy and the security of the confidential data transmitted to the private email accounts. There is also a question of what might have been done with the data after it was sent to the private accounts. Those records would not be subject to the normal rules of transparency or freedom of information requests.

The only reason I can think of for these IRS officials to do this is because they wished to hide what they were doing, which also suggests that what they were doing was downright wrong.

The timing of the correspondence between Lerner and the FEC suggests the FEC attorney sought information from the IRS in order to influence an upcoming vote by the six FEC commissioners. The FEC received a complaint in March 2008 from the Minnesota Democratic Farmer Labor Party alleging that the American Future Fund had violated campaign-finance law by engaging in political advocacy without registering as a political-action committee. The American Future Fund responded to that complaint in June 2008, telling the commission that it had applied for tax exemption in March of that year and was a “501(c)(4) social-welfare organization that was organized to provide Americans with a conservative and free-market viewpoint and mechanism to communicate and advocate on the issues that most interest and concern them.” According to the e-mail correspondence, a month after receiving the American Future Fund’s response, the FEC general counsel’s office — which is prohibited under law from conducting an investigation into an organization before the FEC’s six commissioners have voted to do so — contacted Lerner to investigate the agency’s tax-exempt status. [emphasis mine]

Simply put, the law states that when the FEC receives a complaint, the commission must then decide whether to initiate an investigation. Until it does so, however, it is a crime for the FEC’s general counsel to do any investigation. It is also a crime for the IRS to provide them any confidential tax information. Yet, the FEC’s general counsel did do an investigation on at least two conservative groups prior to a vote and Lois Lerner at the IRS provided them what they wanted, all illegally.

It appears that for justice to be served and for trust to be restored to these bureaucracies a lot of people need to be fired. Unfortunately, I do not expect that to happen. The Democrats clearly want to take advantage of this corrupt bureaucracy to wield power and destroy their enemies, and the Republicans are too wimpy to fight back. The result: The corruption and abuse of power will continue to happen, and it will happen with increasing aggressiveness against conservatives.

Retiring IRS lawyer Carter C. Hull implicated the IRS Chief Counsel’s office, headed by Obama appointee William J. Wilkins, and Lois Lerner, the embattled head of the IRS’ exempt organizations office, in the IRS targeting scandal and made clear that the targeting started in Washington, according to leaked interviews that Hull granted to the Oversight Committee in advance of Thursday’s hearing.

It appears he is naming names. Thursday’s hearing should be quite interesting.

The lawyer for IRS official Lois Lerner is pushing to get her full immunity in exchange for her full testimony to Congress.

The article makes two very good points: One, it will be difficult to prosecute anyone at the IRS for its harassment of conservatives, and two, Lerner’s full testimony is likely not going to have any earthshaking bombshells. She will state that the White House had nothing to do with the harassment (whether that is true or not), and that the harassment was merely the result of some bad management decisions.

And thus, the government’s power over us will rise, and freedom will experience another cut in its continuing death of a thousand cuts.

Hofacre said she was outraged last month when IRS higher-ups, including Lois Lerner, then the head of the IRS tax-exempt division, blamed the problem on employees in Cincinnati. “I was furious,” Ms. Hofacre told interviewers. “It looked like Lois Lerner was putting it on us.”

Yup, that is exactly what Lerner was doing — looking for a fall guy.

The conservative refused, and the case went to court, where all charges were dismissed. Nonetheless, the conservative subsequently decided that the harassment from the government, which also included a visit from the FBI, was not worth it, and has not run for office since.

In other words, Lerner’s harassment worked, to the benefit of the Democratic Party.
