<p>As per the provisions in last year&#8217;s reconciliation budget bill (dubbed for propaganda reasons by Trump the &#8220;One Big Beautiful Bill Act&#8221;), the FAA was authorized to begin charging fees (another word for taxes) on the mass of each launch payload. The agency <a href="https://www.federalregister.gov/documents/2026/04/22/2026-07789/space-launch-and-reentry-licensing-and-permitting-user-fees">last week announced</a> it is now doing so.</p>

<blockquote><p>For 2026, that fee is 25 cents per pound of payload, capped at $30,000 per launch or reentry. The fees would fund work on improving integration of launches and reentries into the national airspace system directed by an FAA reauthorization act in 2024.</p></blockquote>
<p>Though the amount per launch is small compared to the cost of the launch itself, this new tax is expected to provide ample funds to allow the FAA to expand its licensing operations to meet the growing launch industry. The real challenge will be whether the bureaucracy can stay focused on its main task of serving the public, or use the money to build a new bureaucratic empire aimed at garnering power over the private sector. History suggests we should be pessimistic, and expect the latter.</p>
<p>In the meantime, rocket companies are simply going to apply this new tax to the makers of their payloads, who in turn will have <em>their</em> customers pay the cost.</p>

<p>It appears the Senate appropriations bill that <a href="https://behindtheblack.com/behind-the-black/points-of-information/the-senate-led-by-ted-cruz-endorses-nasas-failed-sls-orion-and-lunar-gateway/">was put forth last week</a> by senator Ted Cruz (R-Texas), head of the Senate&#8217;s commerce committee, was not simply filled with pork, it <a href="https://arstechnica.com/space/2025/06/companies-may-soon-pay-a-fee-for-their-rockets-to-share-the-skies-with-airplanes/">also establishes</a> a new tax structure for rocket launches, with the money supposedly allocated to pay for the increased red tape required by the FAA.</p>
<blockquote><p>Cruz&#8217;s section of the Senate reconciliation bill calls for the FAA to charge commercial space companies per pound of payload mass, beginning with 25 cents per pound in 2026 and increasing to $1.50 per pound in 2033. Subsequent fee rates would change based on inflation. The overall fee per launch or entry would be capped at $30,000 in 2026, increasing to $200,000 in 2033, and then adjusted to keep pace with inflation.</p></blockquote>

<p>In a statement by Cruz during a senate hearing last week, he justified these new taxes as follows:<br />
<span id="more-114840"></span></p>
<blockquote><p>Cruz said the rising number of space launches will &#8220;add considerable strain to the airspace system&#8221; in the United States. Airlines and their passengers pay FAA-mandated fees for each flight segment, and private owners pay the FAA a fee to register their aircraft. The FAA also charges overflight fees to aircraft traveling through US airspace, even if they don&#8217;t take off or land in the United States.</p>
<p>&#8220;Nearly every user of the National Airspace System pays something back into the system to help cover their operational costs, yet under current law, space launch companies do not, and there is no mechanism for them to pay even if they wish to,&#8221; Cruz said. &#8220;As commercial spaceflight expands rapidly, so does its impact on the FAA&#8217;s ability to operate the National Airspace System. This proposal accounts for that.&#8221;</p></blockquote>
<p>All this may be true, but this new tax is just another way for the corrupt DC crowd to squeeze more money from American citizens without any real benefit, and at the same time abdicate Congress&#8217;s responsibilities to control spending and the federal bureaucracy.</p>
<p>First, the bill specifically creates a special FAA budget line item in which to dump these taxes, and then gives that 70% of that money forever to the FAA&#8217;s commercial space office (AST).</p>
<blockquote><p>70 percent of the amounts deposited into the fund shall be available for such purposes and shall be available <strong>without further appropriation and without fiscal year limitation</strong>. [emphasis mine]</p></blockquote>
<p>What a great system to grow government, divorced entirely from the legislative and elective process!</p>
<p>Second, the bill assumes that AST must grow exponentially to match the growth in launches, an assumption that is false. AST might need more staffing and money in the coming years to meet the increased number of launches, but there is no evidence it needs to grow this much. Once Trump took office and AST was no longer forced to do the scads of unnecessary paperwork forced on it by Biden it has not only had no problem meeting the increased launch rate in 2025, the red tape faced by rocket companies has actually <em>gone down</em>.</p>

<p>Cruz&#8217;s proposed taxes and fees will simply fund the endless growth of a new government bureaucracy that isn&#8217;t needed to this extent. Eventually this bloated bureaucracy is going to have to to justify its existence, and to do so I guarantee it will then lobby for more launch regulations. That is what has always happened when Congress has created these kinds of independently-funded bureaucracies, and I guarantee it will happen here again with the FAA.</p>
<p>Thank you Ted Cruz and our Republican-controlled Senate! And Republicans wonder why they have had difficulty getting the voters to support them enthusiastically. Why should we? We vote to have them shrink government, and all they ever do is grow it.</p>
<p>Elon Musk&#8217;s call for a new political party during his Trump kerfuffle two weeks ago amid his disgust at the budget proposal in Congress might very well make sense.</p>

<p>That the tax was voted down so conclusively suggests there actually might be some brain cells among the elected officials in New Mexico. Hard to believe, considering that the tax was actually proposed at a time when New Mexico&#8217;s only customer for space launches, Virgin Galactic, is in trouble and might go bankrupt. Raising its taxes would likely have only guaranteed that company&#8217;s failure.</p>

Mere hours after New Shepard completed its first suborbital manned commercial flight, a Democrat in the House of Representatives introduced a bill in Congress <a href="https://www.foxbusiness.com/politics/commercial-spaceflight-the-next-frontier-for-taxes">to impose a tax on private manned spaceflight.</a></p>
<blockquote><p>Oregon Democrat Rep. Earl Blumenauer, who is a member of the House Ways and Means Committee, on Tuesday introduced what he is calling the Securing Protections Against Carbon Emissions (SPACE) Tax Act, which would create excise taxes on commercial space flights carrying human passengers for purposes other than scientific research.</p>
<p>&#8220;Space travel isn’t a tax free holiday for the wealthy,&#8221; Blumenauer wrote on Twitter. &#8220;We pay taxes on plane tickets. Billionaires flying into space—producing no scientific value—should do the same, and then some.&#8221;</p>
<p>The measure would include a per-passenger tax on the price of a commercial flight to space and a two-tiered excise tax for each launch into space. The first tier would apply to flights between 50 miles and 80 miles above Earth’s surface, while the second &#8220;significantly higher&#8221; rate would apply to flights more than 80 miles above Earth’s surface.</p></blockquote>
<p>This typical Democratic Party response to the acheivement of others reminds me of a pertinent quote from Ronald Reagan:</p>
<blockquote><p>Government’s view of the economy could be summed up in a few short phrases: If it moves, tax it. If it keeps moving, regulate it. And if it stops moving, subsidize it.</p></blockquote>
<p>While Reagan was describing many of the actions of politicans from both parties, the Democratic Party is today particularly abusive. Private enterprise has in the past decade done things in space the government and NASA spent years trying to accomplish, with zero success, while wasting billions of taxpayer dollars. The Democrats resent that success, and are very eager to squelch it. Rather than have any American achievement in space, created by the citizens of the nation and independent of their interference, they would rather destroy it. Even as they extort as much money as they can from it.</p>

<blockquote><p>The bill would repeal the space tax formula and exempt space flight income from state taxes, which Lackey contends would give companies like SpaceX, Virgin Galactic and United Launch Alliance an incentive to stay in the state. For example, Moon Express, a startup working to mine the moon for natural resources, moved from Mountain View to Florida in 2016, Lackey said.<br />

In an email, Moon Express CEO and founder Bob Richard reiterated a statement he made last year that the decision to move was “in part due to the state of Florida’s progressive economic development incentives designed to attract commercial space companies.”</p></blockquote>
<p>Since California has rigged its elections in a way that makes it impossible for Republicans to win, Republicans have little power in the state legislature. I therefore don&#8217;t expect this bill to pass.</p>

The passage this weekend of the new tax package <a href="https://pjmedia.com/news-and-politics/gop-senator-passing-tax-reform-without-reading-full-bill-different-obamacare-passage/">illustrates</a> that the Republican-led Congress really is little different than the Democratic-led Congress that passed Obamacare without reading it.</p>
<blockquote><p>PJMedia asked Rounds if he would have time to read the full text before casting his vote.<br />

“No, because the entire bill, there’s two separate parts, first of all, there’s a summary of what each of the parts does, that part we’ve been able to read. The actual text itself will be completed and then it will go into a conference committee where it will come back out again. So most of us have looked at all of the analysis of each one of the sections, section-by-section, that part has been completed,” Rounds told PJM on Capitol Hill on Friday evening.<br />
<br />
“But there will still be more work to be completed in terms of the actual fine language within the bill itself.”</p></blockquote>
<p>In other words, we need to pass the law to find out what&#8217;s in it.</p>
<p>This stinks. Though there is some evidence that the new tax law will lower taxes (which generally is a good thing), no one really knows what the law&#8217;s full consequences will be. A responsible Congress would never pass such a thing. Congresses before the 1960s never did.</p>
<p>Laws are made of words. If you vote for a law but don&#8217;t know the words that actually make up the law you guarantee that some of those words will impose tyranny. This process, and the law that results, is no different than Obamacare, and will likely result in similar disasters.</p>

The Franchise Tax Board of California <a href="http://www.sfchronicle.com/business/article/California-plans-for-collecting-taxes-on-11119631.php">has proposed</a> new regulations that would allow the state to tax commercial launch companies.</p>

<blockquote><p>The rules are designed to apply to any company operating in California that generates at least half the money it takes in from “space transportation” — defined as the movement of people or property 62 miles above the surface of the Earth. That’s the internationally recognized line that separates our planet from the rest of space. It would apply to companies that use California as a launchpad, not California companies launching from other states, like Texas or Florida. </p></blockquote>
<p>Essentially, they will tax any launch from Vandenberg, basing the tax on the distance the payload flies while still attached to the rocket and still the responsibility of the launch provider.</p>
<p>This is essentially a tax on SpaceX, since they are California&#8217;s only major launch company. This is also a tax on Vandenberg, the only spaceport in the state. The result? Expect future companies to flee California. Expect new spaceports to spring up elsewhere. As noted in the article:</p>

<p>But isn&#8217;t Obamacare the &#8220;Affordable Care Act&#8221;, as Obama and the Democrats named it? It can&#8217;t cost us more. They said so! They promised!</p>

<p>Though the last time the gas tax was increased was during Bill Clinton&#8217;s presidency, the only reason the highway fund is short of money is that they don&#8217;t spend it wisely, wasting a lot on stupid projects. (Sounds a lot like almost everything the federal government does, doesn&#8217;t it?) Rather than increase the tax, Congress should take a close look at how the money is being spent, and clamp down.</p>
<p>I should note that House Republicans have already said that they will oppose this increase. Whether they stay that course however remains to be seen.</p>

										<content:encoded><![CDATA[<p>The Democrats in the Senate <a href="http://abcnews.go.com/blogs/politics/2012/07/with-vp-biden-presiding-senate-passes-democrats-tax-cut-plan/">have passed their tax plan</a>, extending the Bush tax rates for families making under $250,000 for one year while allowing the rates for families earning above $250,000 to expire.</p>
<p>The big Democratic claim has been that in order to balance the budget richer people have to pay more of their fair share. Okay, so now they&#8217;ve made their point by law. If I were the Republicans I&#8217;d accept it, since we all know that this tax increase on higher income taxpayers will do <em><strong>nothing</strong></em> to lower the deficit. We could raise the tax rate for anyone earning more than $250K to 100 percent and we would still have a gigantic yearly deficit.</p>
<p>What will the Democrats next claim when this tax increase fails? It won&#8217;t matter. The problem is spending, and the failure of this tax plan will further demonstrate that point. The federal government has to learn to live within its means.</p>
