FISA court condemns FBI

The FISA court has issued a rare public rebuke of the FBI over its apparent misconduct and illegal tampering of evidence, as documented by the inspector general report released last week, misconduct aimed at misleading the court into issuing uncalled FISA warrants.

[T]he chief judge of the Foreign Intelligence Surveillance Court [FISC] strongly criticized the FBI over its surveillance-application process, giving the bureau until Jan. 10 to come up with solutions, in the wake of findings from Justice Department Inspector General Michael E. Horowitz.

The order, from the court’s presiding judge Rosemary M. Collyer, came just a week after the release of Horowitz’s withering report about the wiretapping of Carter Page, a former campaign adviser to President Trump. “The FBI’s handling of the Carter Page applications, as portrayed in the [Office of Inspector General] report, was antithetical to the heightened duty of candor described above,” Collyer wrote in her four-page order. “The frequency with which representations made by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable.” [emphasis mine]

This is another independent confirmation that the behavior of the upper echelons of the FBI during the Obama administration was corrupt, apparently acting to take sides during the 2016 election against Donald Trump.

The highlighted words however are to me very distressing. The FISA court is asking the bad apples to come up with new procedures to prevent them from behaving as bad apples again. If this is all that happens then they will have gotten away with it, and will proceed to do worse in 2020 and beyond.

What needs to happen is firm contempt citations against specific individuals, people like James Comey, followed by prosecution. Until that happens the bad guys will still be in charge, and the American justice system will still be corrupted.

    The most promising part of this letter is the last paragraph:

    IT IS FURTHER ORDERED, pursuant to FISC Rule of Procedure 62(a), that the government shall, no later than December 20, 2019, complete a declassification review of the above-referenced order of December 5, 2019, in anticipation of the FISC’s publishing that order. In view of the information released to the public in the OIG Report, the Court expects that such review will entail minimal if any redactions.

    I wonder if the judge will also order further declassification of her earlier report, which showed that 85% of searches of the NSA database were in violation of procedures. A more recent report by another FISC judge (his name escapes me) shows that not much has changed since Judge Collier’s report.

    The FISC judges (and their supervisor, Chief Justice Roberts) should be investigated and held accountable for any misconduct. I wonder if Judge Collier is as upset as she seems in this letter, or if she’s mostly trying to deflect responsibility for her role. The OIG report didn’t show violations that were more egregious than those shown in her report; she has no apparent reason to be more angry now than before.

    James Comey, John Brennan, James Clapper, Strozk, Page, the Ohrs, Baker, etc, etc, etc. And of course, Ma Barker, Barak Obama and the DNC.

    The arrogance and hubris of the abuse of power in the American justice system and the American government must never be allowed to exist at these kinds of ubiquitous levels. NEVER.

    The Founders were truly Progressive and concerned with freedom, they were real Progressives. Not like the “Progressives” who pose as true Progressives who in fact are just dishonest Socialists and Leftists. Frauds to a man and a woman.

    The Judge had an opportunity to act when it mattered, and she didn’t. In April of 2017 Mark Levin’s Landmark Legal Foundation filed a Amicus brief with the FISC informing the Court of alleged FISA application irregularities based on public news reports. 5 days later the FISC issued a nebulous ruling stating there was “no matter pending before the court,” with respect to such amicus requests.
    Two years later she has a change of mind.

    The Founders weren’t “progressive.” That word has nothing to do with ‘progress.’ It’s not interchangeable with the actual word, progress.
    This is why we can’t have nice things–the Left always plays with the language.

    Wayne – A locale talk show host used to call the changing of the language one of the tools the Left used to control the argument. Many examples:

    Gay. Vs homosexual
    Undocumented Immigrant and Dreamer vs. Illegal Immigrant
    Fascist now includes right-wing in the definition
    Nazi – National Socialists as right wing
    B.C.E. vs B.C – the birth of Christ is a historical moment regardless of the religous aspects.
    Etc.

    When you control the language you distort the argument severely and you start from a disadvantage. Refuse the these words and their redefinition daily and gain ground.

    Wayne, none taken, we understand what is going on and the techniques being used in order to screw with the mind of the public in order to control language and redefine words and terms. Its no secret any more to many, but not to all.

    If you think about it for a moment the Founders actually were the original Progressives, their thinking was a paradigm shift in governance. “Progressives” today have again highjacked the word progress so as to have the general public believe that the term is in their interests. Who would not want to make progress, its such a positive word.

    No, just another example of taking the Saul Alinski rules for radicals and manifesting them in real time.

    One problem with that, many have caught on to the psyops deception. So the Founders were IMO definitely Progressive in the real spirit of the word, and the “Progressives” of today are what they have always been, Leftists, Socialists, frauds (Democrats) and liars attempting to highjack something that can be good and turn it to their own selfish really Marxist purposes.
