At the government’s own request, a federal appellate court Friday dismissed the Obama administration’s appeal of an order that stopped the president from enforcing the HHS birth control mandate against a Bible publisher. The administration’s retreat marks the first total appellate victory on a preliminary injunction in any abortion pill mandate case.
Alliance Defending Freedom attorneys representing Tyndale House Publishers say the administration is apparently nervous about trying to defend its position that a Bible publisher is not religious enough for a religious exemption to the mandate. “Bible publishers should be free to do business according to the book that they publish,” said Senior Legal Counsel Matt Bowman. “The government dismissed its appeal because it knows how ridiculous it sounds arguing that a Bible publisher isn’t religious enough to qualify as a religious employer.”

The publishing house gives over 90% of all its profits back to religious organizations.
I bet they at some point said that if push came to shove they would just convert over to a religious non profit or not for profit charity. And thus be exempt.
Or someone realized if this went to court all it would do is set a limit on an organizations charity before it would be considered a religious non profit and thus not have to pay.
Once they start arguing over the limit the case is lost for the government. All that could happen after that is organization after organization would go to court to have the limit set lower and lower.
We want them to make a definition. We want a limit. That way all businesses can reach that limit and thus never pay.
We also want them to list the rules for total exemptions like McD’s gets for its employees. Instead of just begging for one and having the WH write you one. We want the real reason why 500,000 McD employees don’t need coverage what every other employer needs to provide it.
