The trial of an ex-JPL computer specialist who claims he was fired for his Christian beliefs ended today.

Closing arguments ended Monday after a five-week trial. The case will be decided by Superior Court Judge Ernest Hiroshige, who must first review written arguments from both sides and could take months before announcing a verdict. Both sides agreed to forgo a jury.

Passover

For the next two days posting will be light. I am in Chicago visiting family for Passover, the annual Jewish holiday celebrating the release of the Jews from slavery in Egypt. During the Seder meal, Jews read the Haggadah, which retells the story of the Jewish slavery in Egypt and their escape, with the idea of reminding each person what is like to be a slave, and then to be free. As it says in the Haggadah,

In every generation each individual is bound to regard himself as if he had gone personally forth from Egypt.

Tonight, this is what Jews do. It would be nice if all people reflected on this and did the same.

“A train wreck for the Obama administration.”

Trying to determine what the Supreme Court will rule on any issue by analyzing the questions they ask beforehand has generally been a poor predictor of their final decision. Sadly, we really won’t know what the Supreme Court will do until they do it.

Moreover, from my perspective it would be far better for Congress to repeal the law rather than have the court rule it unconstitutional. In the former it will be done by legislative action, backed by the voters. In the latter it would be the decision of nine unelected individuals, essentially expressing their personal opinions. In a true democracy the former is definitely preferred.

The four best legal arguments against Obamacare.

The fourth is probably the most devastating to Obamacare. No contract can be enforced if you are forced to sign it.

American contract law rests on the principle of mutual assent. If I hold a gun to your head and force you to sign a contract, no court of law will honor that document since I coerced you into signing it. Mutual assent must be present in order for a contract to be valid and binding.

Once again, we are skirting around that forgotten word called freedom. Obamacare has nothing to do with freedom. It requires participation, something that is fundamentally hostile to this country’s culture and law.

The reckoning.

Today, it’s the Catholic Church whose free-exercise powers are under assault from this cascade of diktats sanctioned by — indeed required by — Obamacare. Tomorrow it will be the turn of other institutions of civil society that dare stand between unfettered state and atomized citizen.

Rarely has one law so exemplified the worst of the Leviathan state — grotesque cost, questionable constitutionality and arbitrary bureaucratic coerciveness. Little wonder the president barely mentioned it in his latest State of the Union address. He wants to be reelected. He’d rather talk about other things.

Remember, the power of the state is not always wielded by those you agree with. From the right or the left, fear that power, because it will come after you both when it finally has the ability to do so.

Boycotting the boycotters.

I’ve said little about the Rush Limbaugh kerfuffle this week, mostly because I consider the whole thing to be a manufactured scandal created by the Democrats to distract everyone from their effort to squelch religious liberty. However, this fake scandal has now morphed into a campaign to destroy Rush Limbaugh, which when you consider it is quite consistent with the Democratic Party’s general lack of respect for freedom and personal liberty. First they came after the church, now they are going after one of the more important commentators in the conservative movement.

It doesn’t matter whether you agree with Limbaugh. What matters is that this effort to destroy him is really an effort to silence any criticism of Obama and the liberal/leftwing agenda. Such attacks cannot be supported under any condition. These cowardly businesses that are fleeing Limbaugh, and thus are supporting a leftwing form of McCarthyism, should be made to suffer for this cowardice.

Washington had come to Rhode Island in celebration of that state’s ratification of the Constitution. This paragraph, written by these immigrant Jews, speaks directly to today’s far less tolerant government and society that now believes it has the right to squelch religious freedom:

Catholic, Lutheran, Baptist and Jewish leaders all testified at a Congressional hearing today that they would go to prison rather than obey the Obamacare mandates being imposed by the Obama administration. Key reaction from one Congressman:

“Well, just so everybody understands what is going to happen: These guys are either going to go to jail because they won’t violate their religious beliefs, or the hospitals and the schools are going to close, which means governemnt is going to get bigger, because they’re going to have to fill the void that is left when you guys quit doing it. And maybe that’s what [the Obama administration] wanted all along.”

When did we become a nation where government officials can order anyone to do anything, even if that order contradicts a person’s personal religious beliefs? And if you are a Democrat and don’t mind Obama’s orders because you agree with them, just remember that the Democrats are not going to be in power forever. Do you want a conservative Republican to have that same power?

In a free society, no politician should ever have such power. It is essential that everyone stand up against this attack on freedom. And it is even more important that these thugs be removed from office as soon as possible.

Obama administration has decided that volunteering will work to forgive a student loan — as per the law that Congress passed — as long as that volunteer work is not for a religious organization.

Congress created the loan forgiveness program in 2007 to encourage graduates to enter the public service field. In exchange for that service, the remaining balance of student loans would be considered repaid after 120 full payments.

To qualify for the loan forgiveness, one must now work for a federal, state or local government agency or organization, including public water, bridge or housing districts, or nonprofit organizations designated as tax exempt by the Internal Revenue Service.

More and more, it is obvious that this administration and those who support it are hostile to religion (except for Islam), hostile to freedom, and focused on gathering all power and control to the federal government.
