FISA court condemns FBI

The FISA court has issued a rare public rebuke of the FBI over its apparent misconduct and illegal tampering of evidence, as documented by the inspector general report released last week, misconduct aimed at misleading the court into issuing uncalled FISA warrants.

[T]he chief judge of the Foreign Intelligence Surveillance Court [FISC] strongly criticized the FBI over its surveillance-application process, giving the bureau until Jan. 10 to come up with solutions, in the wake of findings from Justice Department Inspector General Michael E. Horowitz.

The order, from the court’s presiding judge Rosemary M. Collyer, came just a week after the release of Horowitz’s withering report about the wiretapping of Carter Page, a former campaign adviser to President Trump. “The FBI’s handling of the Carter Page applications, as portrayed in the [Office of Inspector General] report, was antithetical to the heightened duty of candor described above,” Collyer wrote in her four-page order. “The frequency with which representations made by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable.” [emphasis mine]

This is another independent confirmation that the behavior of the upper echelons of the FBI during the Obama administration was corrupt, apparently acting to take sides during the 2016 election against Donald Trump.

The highlighted words however are to me very distressing. The FISA court is asking the bad apples to come up with new procedures to prevent them from behaving as bad apples again. If this is all that happens then they will have gotten away with it, and will proceed to do worse in 2020 and beyond.

What needs to happen is firm contempt citations against specific individuals, people like James Comey, followed by prosecution. Until that happens the bad guys will still be in charge, and the American justice system will still be corrupted.

IG had recommended criminal prosecution of Comey

The law is only for little people: In testimony today before Congress, Justice Department inspector general Michael Horowitz revealed that he had recommended criminal prosecution earlier this year against former FBI director James Comey.

The Justice Department however declined to follow through, essentially letting Comey off the hook.

In the past few weeks there have been many rumors about more criminal referrals by Horowitz in connection with his investigation into the illegal use of the FISA court by the FBI and Obama Justice Department to initiate spying operations on Trump during the 2016 presidential campaign. The conservative press has made much of those rumors.

To my mind, the rumors mean squat, just as Horowitz’s recommendation here against Comey. Until these corrupt officials are actually indicted, the IG can say whatever he wants, but nothing has been accomplished, and future federal employees will know that they can attempt a coup against legally elected lawmakers and face no consequences.

The law is only for little people: Despite a damning Justice Deparment inspector general report that concluded that James Comey had violated the law and broke FBI rules by leaking classified information when he was FBI director, the Justice Department has decided not to prosecute him.

“We conclude that Comey’s retention, handling, and dissemination of certain Memos violated Department and FBI policies, and his FBI Employment Agreement,” reads DOJ watchdog head Michael Horowitz’s report.

The watchdog office said Comey broke FBI rules by giving a memo containing unclassified information to his friend Daniel Richman with instructions to share the contents with a reporter. The office also said Comey failed to notify the FBI after he was fired that he had retained some of the memos in a safe at home. Comey wrote a series of memos about conversations with President Trump he said unnerved him. Comey has stated he wanted to make a record of the interactions because he was concerned President Trump might later lie about them.

Attorney General William Barr will not prosecute the fired FBI director over his wrongdoings.

We are no longer a nation of laws, but of corrupt power and banana republic backroom deals. By aligning himself with the Democratic Party, Comey has obtained that get-out-of-jail card that all Democrats hold. No matter what laws they break, no one in Washington will ever prosecute them, especially if they are in positions of power and are popular commentators on mainstream liberal press outlets like CNN.

Be a Republican, or a conservative, or even an ordinary citizen, however, and be prepared for the entire legal book to be thrown at you instantly, should you even jaywalk.

CNN reporter advocates censorship by the FBI

Words fail me: In an interview of former FBI head James Comey, CNN’s Christiane Amanpour actually had to have the first amendment explained to her by Comey after she suggested that the FBI should act to censor speech it considers “hate speech.”.

“Of course, ‘lock her up’ was a feature of the 2016 Trump campaign,” Amanpour said. “Do you in retrospect wish that people like yourself, the FBI, I mean, the people in charge of law and order, had shut down that language — that it was dangerous potentially, that it could’ve created violence, that it’s kind of hate speech. Should that have been allowed?”

Comey explained the First Amendment to Amanpour, replying, “That’s not the role for government to play. The beauty of this country is people can say what they want, even if it’s misleading and it’s demagoguery.” [emphasis mine]

I am no fan of Comey, as I think he was a willing participant in the effort at the FBI to illegally overturn the 2016 election of Trump. However, he at least has a basic understanding of the Constitution, the fundamental law of the land. For a reporter at a national cable network to not understand this is horrifying.

The video of Amanpour’s comments is posted below the fold. The clip begins with Amanpour giving Comey a platform to condemn any possible investigation into the FBI’s abuse of power. Not surprising, as he and others remain very vulnerable in this matter.

Amanpour then wonders why that the FBI didn’t shut down free speech she and Comey didn’t like. Also not surprising, coming from an employee of a network whose sole purpose these past two years has been to overthrow the legal election of Trump, in league with that corrupt FBI.

And CNN wonders why Trump calls them “fake news”.

The corruption centered on Mueller and Comey

President Trump might have his ethical issues, but at this point the questions surrounding him don’t hold a candle to the corruption revealed in two stories in the past two days about former FBI director James Comey and Special Council Robert Mueller.

The first story describes in enormous detail the flat-out whitewash that Comey and the FBI did in its investigation of the classified Clinton emails that had been found on an unclassified laptop owned by former Democratic congressman and convicted child molester Anthony Weiner. That whitewash included outright lies by Comey before Comgress.

McCabe’s defiant response to his firing incriminates Comey

Working for the Democratic Party: The defiant response yesterday by former FBI deputy director Andrew McCabe to his firing included information that appears to incriminate fired FBI director James Comey.

McCabe is accused of misleading investigators about allegedly giving information to a former Wall Street Journal reporter about the investigation of Hillary Clinton and the Clinton family’s charitable foundation. McCabe asserts in his post-firing statement that he not only had authority to “share” that information to the media but did so with the knowledge of “the director.” The FBI director at the time was Comey. “I chose to share with a reporter through my public affairs officer and a legal counselor,” McCabe stated. “As deputy director, I was one of only a few people who had the authority to do that. It was not a secret, it took place over several days, and others, including the director, were aware of the interaction with the reporter.”

If the “interaction” means leaking the information, then McCabe’s statement would seem to directly contradict statements Comey made in a May 2017 congressional hearing. Asked if he had “ever been an anonymous source in news reports about matters relating to the Trump investigation or the Clinton investigation” or whether he had “ever authorized someone else at the FBI to be an anonymous source in news reports about the Trump investigation or the Clinton investigation,” Comey replied “never” and “no.”

The Justice Department’s inspector general clearly saw this “interaction” as problematic in seeking answers from McCabe. If the inspector general considered this to be a leak to the media, any approval by Comey would be highly significant. Comey already faces serious questions over his use of a Columbia University Law School professor to leak information to the media following his own termination as director.

It must be emphasized that McCabe’s firing was recommended by FBI Office of Professional Responsibility, which is an independent division in the FBI made up of FBI officials. Moreover, his response clearly reveals McCabe’s own Democratic partisan leanings. It also links those leanings to Mueller’s investigation, which further taints it.
