That this ruling took several appeals depresses me. The language of the Constitution on this issue couldn’t be more plain. The government must have probably cause and a warrant before it can do these kinds of things.
What baffles me even more is that the police had probable cause in the specific case above. Why they didn’t bother to simply get a warrant makes no sense.

Of course it made sense. The prosecutors OK’d it. One judge on the panel of three dissented. Our overlords still hope that the SCOTUS will further diminish our rights and are willing to do these things, and in other circuits get away with it. Congress needs to legislate a 4th Amendment Reinstatement Act. They won’t.
The justices also rejected the government’s argument that obtaining a warrant would impede the ability of law enforcement to investigate crimes.
So the government is saying that anything that makes criminal investigations difficult should be ignored. Well there goes the 1st, 4th, 5th and 6th amendments.
