Now that we have clear evidence that the left is nothing more than a revised but reborn Nazi movement — allied with murderous Islamic groups like Hamas, it is imperative we track whether the good people in the world are willing to fight it, or appease it as was done so stupidly in the 1930s when Hitler first began his march for world domination and the extermination of the Jews.

In the past week, it seems more and more that appeasement is the watchword of the day.

First, Israel has repeatedly delayed its invasion into Gaza, mostly because of demands from western leaders, led by Democrat Joe Biden, to hold off so that negotiations can continue to get the hostages released. A news report today further reiterated that Israel has agreed to hold off, pending these negotiations.

The reasoning from Israel is the hope that Hamas will release a “big number” of hostages quickly, such as all women and children. Getting one or two hostages released on a weekly basis — which is what Hamas is presently doing — is not considered acceptable to Israel. At that pace it will take more than two years to get all released, and based on how the news cycle goes, after a few more months Israel will have lost its military initiative and Hamas will likely stop releasing any hostages.

Update on Starship/Superheavy: Lots of work, no sign of FAA launch approval

Link here. The article provides a thorough review of the work SpaceX engineers have been doing in the past six weeks since the company announced on September 5th that it was ready to do a second test orbital launch of Starship (prototype #25) and Superheavy (prototype #9), but has been stymied by the refusal of the federal bureaucracy to grant a launch license.

For example, while waiting the company has done some tank tests with Starship prototype #26, which is not expected to fly but is being used for testing. The article outlines a lot of other details, but this is the key quote:

While Ship 26 started its engine testing campaign, SpaceX looks to be gearing up for a Wet Dress Rehearsal (WDR) for Booster 9 and Ship 25. Related notices have been posted for the coming week, marking the imminent return to a full stack for the next Starship to launch as soon as November, pending regulatory approval. [emphasis mine]

This source, NASASpaceflight.com, now admits that the FAA and Fish & Wildlife will not issue a launch license until November. Previous reports from it have tried to lay the blame for the delays on SpaceX. It now can no longer make that claim.

In April, after noting at great length the lack of harm done to wildlife by the first test launch (as admitted by Fish & Wildlife itself, the agency that is presently delaying things), I predicted the following:

[I]t appears that both the FAA and Fish and Wildlife are now teaming up to block any future launches at Boca Chica until SpaceX guarantees that the rocket and its launchpad will work perfectly. But since SpaceX must conduct launches to determine how to build and further refine the design of that rocket and launchpad, it can’t make that guarantee if it is banned from making launches.

We must therefore conclude that these federal agencies are more interested in exerting their power than doing their real job. They are therefore conspiring to shut Starship and Superheavy development entirely, or at a minimum, they are allowing their partisan hatred of Elon Musk and capitalism itself to delay this work as much as possible. As Lord Acton said in 1887, “Power corrupts, and absolute power corrupts absolutely.”

At that time I thought it very possible no further launches from Boca Chica would ever be approved. In May I refined that prediction, stating that come August the “…launch license will still not be approved, and we will still have no clear idea of when that approval will come. Nor should we be surprised if approval does not come before the end of this year.”

At the time that prediction was poo-pooed, with claims that I did not understand the regulatory process and that the government certainly did not want to stand in the way. It now appears my prediction was right on the money, and worse, my first prediction might be closer to the truth, that while the federal government doesn’t want to come right out and say, “No more launches from Boca Chica!”, it is imposing so many delays and requirements there that it makes the location impractical for SpaceX to use it as a launch test site.

The company desperately needs to get its second Starship/Superheavy launch site at Cape Canaveral operational. Otherwise it is unlikely it will ever be able to complete the development of this rocket.

You can’t negotiate with someone who wants to kill you

Gaza and Israel

The horrors that occurred in Israel this past weekend when Hamas terrorists committed an organized attack on innocent civilians living near the Gaza Strip should finally put an end to demands that Israel negotiate with these people. Such negotiations are as pointless as the endless negotiations seen in the 1930s with Hitler. All you will do each time is to give up ground that is then used by these villians to continue waging war against you.

I say this with utter confidence for two reasons:

1. For decades the founding documents of both the Palestinian Authority (in control of the West Bank) and Hamas (in control of Gaza Strip) have made it very clear that they do not recognize the existence of Israel, and that their eventual goal is its utter destruction, including the elimination of all its citizens. Hamas this weekend demonstrated how these thugs intend to achieve that elimination, by killing every Israeli Jew they can find.

2. Repeatedly Israel has demonstrated forcefully its willingness to live in peace with the Palestinians, and each time has been met with hate and murder. In Gaza specifically Israel unilaterially exited in 2005, actually forcing Israelis who had settled there to give up their property so that Gaza could be handed in its entirety to the Palestinians as their own independent nation. At that moment the Palestinians had an opportunity to prove they wanted to live in peace. Instead, they elected a terrorist organization to run Gaza, and have spent the last two decades using it as a base for attacking and killing Israelis.

Another lawsuit filed against SpaceX

They’re coming for you next: In what appears to be another example of lawfare by the left against Elon Musk, a female engineer has filed a lawsuit against SpaceX, claiming it discriminated against her in pay.

The lawsuit is absurd, based on the suit itself.

The lawsuit was filed on Tuesday in Los Angeles Superior Court by SpaceX engineer Ashley Foltz, who says she was hired at a salary of $92,000, even though men with similar or less experience were offered as much as $115,000. According to her LinkedIn, Ashley was hired in September 2022 as a propulsion engineer. She did not immediately respond to TechCrunch’s request for comment.

According to the complaint, Foltz learned about the salary discrepancies when a new California law went into effect requiring employers to include pay scale in their job postings. The salary range for her job was $95,000 to $115,000, so SpaceX gave her a raise — but only to the lowest end of the band.

In other words, Foltz didn’t negotiate a good salary when she was hired, and when the California law revealed how low it was, SpaceX immediately raised her salary to the bottom end of its pay scale, indicating also its opinion of her work. I suspect a full review of the salaries the company pays will reveal that women get a wide range of payment, depending on their worth. SpaceX certainly doesn’t discriminate against women, since its CEO is a woman and over the years women engineers have led many major projects.

The lawfare from the left against Elon Musk, one of the most successful Americans in decades, is becoming quite obvious. Besides this private suit, another group of environmentalists are suing SpaceX and the FAA to block future launches from Boca Chica. The Biden administration meanwhile is using numerous agencies to gang up on Musk: the Justice Department is suing it for not illegally hiring illegal immigrants, the FAA and Fish & Wildlife are blocking its Superheavy/Starship test launches, the EEOC is suing Tesla while Justice and the SEC investigate it, and the FTC and SEC are investigating Musk’s purchase of Twitter.

If you still think this full court press of government action is an accident, or entirely innocent, then you are naive beyond belief. Musk is now considered an opponent of the left, and so the left is going after him, and abusing the power of government to do it. It doesn’t care that Musk has produced tens of thousands of new jobs, revolutionized several major industries, and brought wealth to places that were previously poverty-stricken. To the left, the only thing that matters is its hold on power. Threaten that, and it will do whatever it can to destroy you, even if it means people will be starving in the street.

SpaceX sues to get Justice’s discrimination suit thrown out on constitutional grounds

SpaceX on September 15, 2023 filed suit in Texas to get the Justice Department’s August 24th discrimination suit — which claims that the company discriminates against illegal aliens because it obeys State Department security regulations forbidding such hiring — thrown out on constitutional grounds.

From the complaint [pdf]:

But aside from being factually and legally insupportable, the government’s proceedings are unconstitutional for at least four reasons: (1) the administrative law judge (ALJ) adjudicating the government’s complaint was unconstitutionally appointed; (2) the ALJ is unconstitutionally insulated from Presidential authority because she is protected by two layers of for-cause removal protections; (3) the ALJ is unconstitutionally purporting to adjudicate SpaceX’s rights in an administrative proceeding rather than in federal court; and (4) the ALJ is unconstitutionally denying SpaceX its Seventh Amendment right to a jury trial.

The suit specific names two of these administrative judges, as well as attorney general Merrick Garland, as defendents. It also outlines in detail how SpaceX follows the State Department’s law protecting U.S. technology scrupulously, while hiring the most talented people of all races, including non-citizens after getting State Department permission. Even so, the company’s complaint focuses on the unconstitutionality of the Justice Department’s administrative attack, demanding its dismissal for these reasons alone.

As I noted when the Justice Department’s lawsuit was first announced,

This suit is utter garbage and puts SpaceX between a rock and a hard place. I guarantee if SpaceX had hired any illegal or refugee who was not yet a legal citizen, Biden’s State Department would have immediately sued it for violating other laws relating to ITAR (the export control laws mentioned) which try to prevent the theft of technology by foreign powers.

That SpaceX has chosen to fight this lawsuit first on constitutional grounds suggests the company has fundamentally come to the same conclusion. Musk has decided to fight back hard against Biden’s effort to squash him both politically and legally.

Good news? FAA issues own report on April Starship/Superheavy launch

The FAA today closed out its own investigation into the April test launch failure of SpaceX’s Starship/Superheavy rocket, stating that it found “63 corrective actions SpaceX must take” before another launch license will be issued.

Corrective actions include redesigns of vehicle hardware to prevent leaks and fires, redesign of the launch pad to increase its robustness, incorporation of additional reviews in the design process, additional analysis and testing of safety critical systems and components including the Autonomous Flight Safety System, and the application of additional change control practices.

It is not clear how many of these corrections have already been completed by SpaceX. The FAA made it clear however that it does not yet consider its requirements to have been met.

The closure of the mishap investigation does not signal an immediate resumption of Starship launches at Boca Chica. SpaceX must implement all corrective actions that impact public safety and apply for and receive a license modification from the FAA that addresses all safety, environmental and other applicable regulatory requirements prior to the next Starship launch.

The timeline suggests FAA is demanding additional actions from SpaceX. The company submitted its own investigation report to the FAA on August 16th. The FAA then spent almost a month reviewing it, during which it almost certainly decided some of SpaceX’s corrections were insufficient. It has now followed up with its own report, listing additional actions required.

Remember, no one at the FAA is qualified or even in a position to do a real investigation. They are simply acting as a chess kibitzer on the sidelines, making annoying commentary based on less information than held by the players of the game (in this case SpaceX). Unlike a chess kibitzer, however, the FAA controls the board, and can force SpaceX to do its recommended moves, or declare the game forfeited by SpaceX.

If the FAA has required additional actions, we will find out in the next few days when SpaceX destacks Starship/Superheavy and rolls both back into the assembly building. It is also possible we instead shall have a few weeks of back-and-forth negotiations by phone, zoom, paper, and face-to-face meetings, whereby SpaceX engineers will be desperately trying to make FAA paper-pushers understand some of their engineering work which will eventually result in an agreement by the FAA to let SpaceX launch.

Remember, none of this kind of regulatory interference and investigation took place between SpaceX and the FAA during the Trump administration when SpaceX was flying a Starship suborbital test flight almost monthly. The heavy boot of regulation arrived soon after Biden. The two are closely linked.

Senate approves Biden’s FCC nominee, giving him a Democrat majority on FCC

Failure theater: The Senate yesterday voted 55 to 43 to approve Biden’s Federal Communications Commission (FCC) nominee, Anna Gomez, thus giving the Democrats a 4 to 3 majority on the Commission.

This was Biden’s second nominee to the commission, with the first withdrawn when it was clear the Senate opposed the nominee.

Biden tried again in May with the nomination of Gomez, a State Department digital policy official who was previously deputy assistant secretary at the US National Telecommunications and Information Administration (NTIA) from 2009 to 2023. A lawyer, Gomez was vice president of government affairs at Sprint Nextel from 2006 to 2009 and before that spent about 12 years at the FCC in several roles.

Gomez got through the confirmation process with relative ease, though most Republicans voted against her. Both parties seem to expect the FCC to reinstate net neutrality rules now that Democrats will have a majority.

Imposing net neutrality is essentially socialism/communism for the internet. It will squash competition, cost a fortune, and eventually be used as well to squelch dissent online (which translates into silencing conservatives).

Starship and Superheavy: Ready for launch but still blocked by the White House

Elon Musk yesterday tweeted a short video showing Starship prototype #25 as it was stacked on top of Superheavy prototype #9, stating that both were now ready for their orbital test launch, the second attempt by SpaceX to launch this new rocket.

The image to the right is a screen capture from that movie, showing the full rocket ready to go. When it will go however remains a complete unknown, as Musk himself noted in the tweet: “Starship is ready to launch, awaiting FAA license approval.”

In May I predicted that though Musk predicted at that time that SpaceX would be ready to do this launch in August, it would not happen then or likely for months afterward, because the FAA under the Biden administration is slow-walking all launch approvals for SpaceX, as I showed in detail in a later June essay.

It is now September. SpaceX didn’t meet Musk’s original August ready date for launch, but it only missed that target by about five days. And as I predicted, the FAA has also not yet approved the launch license.

SpaceX completes successful 6-second static fire test of Superheavy

SpaceX today successfully completed a full 5-second static fire test of all 33 Superheavy Raptor-2 engines as well as the deluge system of the launchpad at Boca Chica.

The link goes to the live stream, which is still on-going. The static fire test occurs at about 42 minutes, if you wish to see it.

According to the narrators of the live stream, Elon Musk tweeted that the static fire was a success. It certainly appeared to go for the full five seconds, and it certainly appeared more robust than the previous test. We will have to wait however for confirmation that all 33 engines fired as planned.

The company clearly appears just about ready to do an orbital test flight. Too bad the Biden administration still stands in the way. There is yet no word on when the FAA will approve a launch license, and the decision of the Justice Department yesterday to file a bogus discrimination lawsuit against SpaceX strongly suggests the White House is working hard to figure out ways to squelch this private effort by an American citizen and his company.

Biden’s Justice Department sues SpaceX

The corrupt and very partisan Justice Department of the Biden administration today sued SpaceX for discriminating against refugees and illegal immigrants because it restricts hiring to “U.S. citizens and lawful permanent residents.”

The lawsuit states SpaceX “failed to fairly consider” and “refused to hire” the asylees and refugees who ended up applying anyway. It also alleges that SpaceX “wrongly claimed” that the US’s export control laws allowed it to only hire US citizens and lawful residents. Additionally, the DOJ claims SpaceX hired “only” US citizens and green card holders from September 2018 to September 2020.

“Our investigation found that SpaceX failed to fairly consider or hire asylees and refugees because of their citizenship status and imposed what amounted to a ban on their hire regardless of their qualification, in violation of federal law,” Kristen Clarke, the assistant attorney general of the DOJ’s Civil Rights Division, says in a statement.

Justice is demanding compensation and back pay for anyone “deterred or denied employment”, as well as civil penalties.

This suit is utter garbage and puts SpaceX between a rock and a hard place. The Biden administration considers Elon Musk an opponent, and since it is now moving to indict and even imprison all political opposition, it is no surprise it is beginning to use lawfare against him. As I have written repeatedly, it has almost certainly pressured the FAA to slow walk any launch license approvals for SpaceX’s Starship/Superheavy. This lawsuit today simply provides further evidence that my prediction will be right that the next orbital test flight of that rocket will be delayed months.

I will NOT wear a mask, part two

Here we go again! When the first panic over COVID arrived in 2020 and government thugs and their leftist minions in the culture began demanding that everyone wear a mask, I wrote the following:

It apparently has not been enough that they have successfully destroyed a thriving economy, put millions out of work, destroyed the airline, entertainment, sports, and restaurant industries, over a disease that, at best is nothing more than a slight blip in the overall death rate, and at worst will be comparable to similar past epidemics that we lived through without government-imposed panic or economic disaster.

No, destroying millions of lives has not been enough. They need to do more. They need to find more ways to squelch our freedom, nullify the Constitution and the Bill of Rights, and, to paraphrase Orwell, stamp a boot down on our faces, forever.

And in this case, they mean to do this, almost literally.

They are now beginning to demand that we wear masks at all times in public, in the mindless and stupid belief that this will somehow stop COVID-19 from spreading.

I also declared unequivocally that I would not wear a mask, “and if you demand it of me you will have a revolution on your hands.”

Commercial spaceport in Australia signs its first launch contract

Australia’s first commercial spaceport, Equatorial Launch Australia (ELA), has signed a multi-launch contract with a South Korean startup rocket company, Innospace, with the first launch targeting April 2025.

Though Innospace successfully launched a suborbital test flight in March, it has not yet launched a rocket to orbit. Meanwhile, ELA is negotiating with a number of other rocket companies, but it also appears it is having problems with the administrative state in the U.S.

The South Korean company is first off the blocks as it is not subject to the strict technological transfer regulations applied by the United States.

[ELA’s CEO Michael] Jones says delays to the signing of a Technological Safeguards Agreement (TSA) between Canberra and Washington is holding up several potential US customers. “We’re still waiting with bated breath for the TSA, despite a bilateral announcement by Biden and Albanese in Japan in early June that the deal was done and dusted,” he explains. “We were all expecting it to be released by the end of the financial year and the process of being endorsed by Parliament begun”.

A pattern of delay and intransigence in Washington, blocking commercial space, does seem to be developing since Joe Biden took over as president.

SpaceX report on first Starship/Superheavy launch failure submitted to FAA

Though we don’t know exactly when this was done, SpaceX has submitted to the FAA its final report on its investigation into the launch failure during the first Starship/Superheavy test launch in April, and now awaits the FAA’s response.

Now comes the FAA’s review of SpaceX’s investigation, fulfilling the agency’s role as the regulator charged with ensuring public safety during commercial launch operations. “When a final mishap report is approved, it will identify the corrective actions SpaceX must make,” an FAA spokesperson told Ars. “Separately, SpaceX must modify its license to incorporate those actions before receiving authorization to launch again.

Do not expect that response to be fast, or accepting. I predict the FAA will demand a lot more investigation and changes from SpaceX, actions that will take time to implement and be approved. Furthermore, I fully expect the FAA to take at least two months to review the SpaceX report before it issues those demands. As I have been predicting since May, there will be no Superheavy/Starship launch this year.

Unless Congress acts soon, the unelected administrative state will rule unopposed

While much of the conservative press has been focusing on the illegal abuse of power by security agencies like the FBI, the CIA, and the Department of Justice, in the past week a whole slew of stories having nothing to do with election politics or Donald Trump have even more starkly illustrated the growing power of the many alphabet agencies of the federal government’s executive branch, power that is cancelling the real constitutional power of Congress — even as Congress looks on impotently.

Unlike abusive and illegal indictments of Trump, or evidence that the Justice Department and FBI are acting to protect Joe Biden and his son Hunter, however, these others stories have generally gone unnoticed, except by your intrepid reporter here at Behind the Black.

First, on July 26th we had the Space Force proposing new regulations that would allow it to literally take control over all private space assets in any declared international emergency, without any need to compensate the owners.

The Space Force’s draft framework for how commercial satellite services could be called up in times of crisis or conflict to support military missions would allow the Defense Department to deny participating companies the right to sell their wares to any other client in times of “war, major conflict, national or international emergency.” [emphasis mine]

What is the point of owning anything if the U.S. military has the power to simply steal it from you, without paying you for it, anytime any president or Congress on a whim decides to declare an international emergency? Such declarations were once rare, but now they happen routinely, with dire consequences for private citizens, as we all learned during the COVID panic.

On that same day we also learned that the FAA has refused to allow the private company Varda from bringing back to Earth a capsule it had launched to space several months ago, with the express intent to manufacture needed pharmaceuticals in weightlessness that can’t be made on Earth.

Biden reverses late Trump decision to move Space Force headquarters

President Biden yesterday reversed a late Trump decision to move Space Force headquarters from Colorado to Alabama, allowing it to remain in Colorado where most of the former Air Force space operations have been.

Peterson Space Force Base in Colorado Springs has been the preferred choice of the top military space brass ever since the basing process began way back in 2018. Trump’s decision was made over their concerns that moving SPACECOM from its current home (previously the home of Air Force Space Command) would needless delay its full operational capability.

Biden, in the end, shared those concerns. “The most significant factor the President considered was the impact a move would have to operational readiness to confront space-enabled threats during a critical time in this dynamic security environment. U.S Space Command headquarters will achieve ‘full operational capability’ at Colorado Springs later this month. Maintaining the headquarters there maintains operational readiness and ensures no disruption to its mission or to its personnel,” a senior administration official told Breaking Defense in an email. “A move to Alabama, by contrast, would have forced upon that command a transition process between the mid-2020’s and the opening of the new site in the early to mid-2030’s.

Of course, politics was involved as well, with Colorado lawmakers putting great pressure on Biden to make this decision. Alabama lawmakers now say they will fight the decision, but because of the relative speed in which new headquarters can be established, their task is difficult if not impossible.

That difficulty will be reinforced by the proposal of the Senate Appropriations Committee decision to cut the Space Force’s ’24 budget by $1 billion, a 3% reduction. That proposal also has support in the House, which suggests it will become law. Though the cuts are scattered throughout the agency, it will lack the cash necessary to make the expensive shift to Alabama, a fact that will hinder any arguments for making that shift.

Varda blocked from bringing its capsule back to Earth by FAA

Varda has been forced to delay the first return of its capsule from space, loaded with a drug designed to treat HIV/AIDS that can only be manufactured in weightlessness, because the FAA has so far refused to issue “a re-entry license,” a new regulatory power grab the FAA instituted two years ago supposedly to “streamline the launch and reentry licensing process.”

This new language, which I was unaware of and know of no Congressional act approving it, has done exactly the opposite.

A key issue, he said, is that Varda is the first to seek a reentry license under new FAA regulations known as Part 450. Those regulations were enacted by the FAA more than two years ago to streamline the launch and reentry licensing process.

…For the commercial launch industry, the Part 450 regulations have become an area of concern. Only a handful of Part 450 launch licenses have been issued to date as the FAA begins a transition to the new regulations, but those licenses have taken longer to complete than expected, in some cases missing a 180-day statutory deadline. Industry officials raised the issue at a July 13 hearing of the House Science Committee and at a July 11 meeting of an FAA advisory group, the Commercial Space Transportation Advisory Committee. [emphasis mine]

The highlighted language says it all. It also suggests these new regulations, apparently written by the FAA and not Congress, might be contributing to the delays being experienced by SpaceX in its attempt to do test launches of its Starship/Superheavy rocket.

Varda is presently hoping to return the capsule in mid-August. It had begun this re-entry licensing process in early 2021 — more than two years ago — and still does not have that approval. Its business plan is to make money by manufacturing things in weightlessness that can’t be made on Earth — such as this HIV drug — and returning those items to Earth for sale.

Such a plan can’t work if the federal administrative state stands in the way.

Weekend repost: The Democratic Party of thugs and goons

The effort by Democrats to censor Democrat Robert Kennedy from speaking at a House hearing on July 20, 2023 focused expressly on documenting censorship and blacklisting not only illustrated the ugly totalitarian nature of the Democratic Party, it also illustrated their utter lack of self-awareness as well as their inability to think, in any way at all.

The moment he started talking, the Democrats went into censorship mode by making motions to censor Kennedy, points of order, accusations, and finally a vote to table Rep. Debbie Wasserman-Schultz’s (D-Fla.) motion to cancel Kennedy’s “testimony and degradation” and put it behind closed doors so the poor American people would not be subjected to words spoken by Joe Biden’s primary opponent.

Their actions at that hearing are not exceptions to the rule, however, they are the rule. In order to make this fact clear, I think it worthwhile reposting an August 2022 essay, which documented their long term goonish storm-trooper behavior. It didn’t just start at that hearing, it has been going on for a long time.

For the past seven years, since Donald Trump won the presidency in 2016, the Democratic Party and its supporters have increasingly acted like Nazi storm-troopers, willing, able, and eager to crush their opponents at every opportunity, and to do so cruelly and with great viciousness.

I therefore ask, shouldn’t we have exhibited the same amount of rage and fury for the hundreds and hundreds of ordinary Americans these same thugs have harassed and ruined since 2016? Why did it take a raid on Trump to finally bring that rage to the forefront?

Two Americans committed suicide because of Biden administration persecution after they dared protest the questionable election of Joe Biden on January 6th. What about them?

Scores of conservative FBI agents in the past two years have been fired from their jobs, simply because they did not agree politically with the Democrats. What about them?

What about the arrest by the FBI of a Republican candidate for Michigan governor, simply because he had also protested on January 6th the questionable election of thug Joe Biden? Or the threats of violence and murder against Supreme Court justices by leftist Democratic Party allies?

What about the effort by Biden’s labor board to shut down the conservative outlet The Federalist, simply because its founder sent out an anti-union joke?

What about the former Trump lawyer whose career was destroyed, simply because he was a former lawyer of Trump?

These stories are only a small sampling of the political abuses of power exercised by Democrats and the Biden administration time after time against their political opponents in just the last eighteen months. The list is long and painful to read.

Blacklists are back and the Democrats have got “em: On July 4th (an appropriate date), Terry Doughty, chief U.S. district judge of the United States District Court for the Western District of Louisiana, ruled that the evidence clearly showed that the Biden administration, in league with most big social media companies, had been running an aggressive censorship operation against conservatives for the past two-plus years, and issued an injunction banning “numerous top Biden administration officials and agencies from communicating and meeting with social media companies.”

You can read Doughty’s ruling here [pdf]. I strongly urge you to do so, as he is harshly blunt about the ugly actions of the Democrats running the federal government since 2021. His introduction sets the tone, beginning with this quote, “I may disapprove of what you say, but I would defend to the death your right to say it,” and then getting more blunt from there:

SpaceX completes six-engine static fire test of Starship prototype #25

SpaceX yesterday successfully completed a six-engine static fire test of Starship prototype #25, the prototype that will be stacked on top of Superheavy prototype #9 and flown on the next orbital test flight.

Musk said in an interview on Saturday that more than a thousand upgrades were planned before the next flight of the Starship/Super Heavy. Including a significant change to the stage separation system that will see the Starship ignite its engines while still attached to the Super Heavy. Improvements are also being made to the Raptor engines to prevent leaks of super-heated gas which resulted in multiple engine failures during the April launch.

Major repair work and modifications are also underway to the Starship launch pad, after extensive damage occurred during the April 20 test flight.

Musk has also said the company will be ready to launch by August. While it is certainly possible that engineering will cause a slight delay to that schedule, more likely SpaceX will be ready, and then have to sit and wait for the FAA and the Biden administration to issue a launch permit. I am predicting it will not be issued by then, and likely not for months afterward.

Biden administration announces India will sign Artemis Accords

As part of the visit of Indian prime minister Narendra Modi to the U.S., the Biden administration today announced that India has agreed to sign Artemis Accords, becoming the 27th nation to join the American space alliance.

It appears India made this decision after the Biden administration agreed to foster a whole range of cooperative technology exchanges.

Cooperation in advanced computing, artificial intelligence, and quantum information science is also being fostered through the establishment of a joint Indo-US quantum coordination mechanism and the signing of an implementation arrangement on artificial intelligence, advanced wireless, and quantum technologies.

Both countries are working together on 5G and 6G technologies, including Open Radio Access Network (RAN) systems, with plans for field trials, rollouts, and scale deployments in both markets. “Here we’ll be announcing partnerships on open ran, field trials and rollouts, including scale deployments in both countries with operators and vendors of both markets. This will involve backing from the US International Development Finance, for cooperation and to promote the deployments in India,” the official said.

The US will support the removal of telecommunications equipment made by untrusted vendors through the US rip and replace program and welcomes Indian participation in this initiative.

The full list of signatories to the Artemis Accords is now as follows: Australia, Bahrain, Brazil, Canada, Columbia, Czech Republic, Ecuador, France, India, Israel, Italy, Japan, Luxembourg, Mexico, New Zealand, Nigeria, Poland, Romania, Rwanda, Saudi Arabia, Singapore, South Korea, Spain, the United Kingdom, the United Arab Emirates, the Ukraine, and the United States.

One would hope that this decision would help separate India from China and Russia, but this is unclear.

“Segregation today, segregation tomorrow, segregation forever!” On June 5, 2023 federal Judge Mark Pittman of the Northern District of Texas ruled [pdf] that a race-based development agency, dubbed the Minority Business Development Agency (MBDA) and created under Biden administration, was patently illegal under both the U.S. Constitution and numerous civil rights laws, and must cease awarding grants based on race.

The ruling was in response to a lawsuit [pdf] filed for three individuals by the Wisconsin Institute for Law & Liberty (WILL), one of whom, Christian Bruckner, was specifically told by the local office of MBDA “…that it could not help him because of his race.” The lawsuit notes that:

SpaceX confirms Starship prototype to fly on next Superheavy test flight

SpaceX has confirmed that it will use Starship prototype #25 to fly on top of Superheavy prototype #9 on the next orbital test flight.

Starship #25 does not include a lot of the upgrades that have been installed on later Starship prototypes, but by using it SpaceX tells us its focus on that next orbital test flight will be to test Superheavy. Using this less capable Starship gets it used and out of the way so that the kinks in Superheavy can more quickly be worked out.

It also means SpaceX’s prime focus on that second flight will not be reaching orbit, though the company will try nonetheless.

The article at the link also notes that this next orbital test cannot take place any sooner than August, based simply on engineering requirements.

Ship 25 is now at the launch site and awaiting a six-engine static fire test, with Elon Musk noting the pad modifications should be complete in a month, ahead of another month of testing before the next test flight.

This gives the FAA two full months to approve the launch license. I predict however that come August, that launch license will still not be approved, and we will still have no clear idea of when that approval will come. Nor should we be surprised if approval does not come before the end of this year.

Three government agencies now investigating the safety of methane-fueled rockets

We’re here to help you! It appears that three different federal agencies have been tasked to investigate the safety of methane-fueled rockets, which SpaceX, Relativity, Blue Origin, and others are beginning to use for their rockets. It burns cleaner and with more power than kerosene and is easier to handle than hydrogen.

Yet, the federal government under Biden now seems worried a new innovation in rocketry is being developed. First, the FAA is studying the explosive potential of such rockets, according to Brian Rushforth, the manager of the innovation division.

The FAA has set up a test stand at the Dugway Proving Ground in Utah. A crane 43 meters tall will be used to drop stainless steel containers containing mixtures of LOX and methane. A series of tests is planned to start in June on three-week intervals to measure the explosive power of that propellant combination. A second phase, tentatively scheduled for next year, will conduct similar tests with varying velocities. He said the data from those tests will be shared with other government agencies, such as NASA and the U.S. Space Force, along with launch vehicle developers.

Meanwhile, NASA and the Space Force are jointly doing a separate study on how methane-fueled rockets threaten the launch range and other nearby launchpads.

In all three cases it can be argued that these studies make sense. It also can be argued that the Biden administration is putting pressure on these agencies to find ways to squelch this new technology, especially because it is central to the development of SpaceX’s Superheavy/Starship rocket, and there is real hostility in Democrat/leftist circles to Elon Musk. This latter argument is further strengthened when you consider the explosive possibilities of hydrogen fuel, used by the space shuttle for decades as well as NASA’s SLS rocket. I can’t imagine its danger is less than methane. If hydrogen has been determined to be okay why should methane now be considered a threat?

Either way, we can be sure of one thing: These studies will slow down development by SpaceX and others of these new methane-fueled rockets. They will also provide ammunition for outside environmental groups who want to file further lawsuits against these companies to stop their rockets from launching.

They’re coming for you next: Because the Saint Francis Health System in Oklahoma has always kept a single candle lit in its hospital chapels, Biden administration officials are now threatening to shut down five Catholic hospitals in Oklahoma, citing federal government fire safety requirements.

If Saint Francis does not comply, the government will revoke its ability to obtain any Medicare, Medicaid, and the Children’s Health Insurance Program (CHIP) payments for treating patients, in essence blocking those patients from healthcare while threatening the entire Saint Francis Health System with bankruptcy.

In response, the Becket Fund for Religious Liberty (as legal representative of St. Francis) sent a letter [pdf] in protest, noting that the Biden administration’s goal has nothing to do with fire safety, but to censor and squelch the religious practice of the St. Francis Health System:

Environmentalists sue FAA, demanding it shut down Boca Chica and Starship

entire Boca Chica operation, if the environmental radicals get their way.

A group of environmental groups as well as a non-profit corporation calling itself the Carrizo/Comecrudo Nation of Texas, Inc, today filed a lawsuit against the Federal Aviation Administration FAA), demanding it shut down SpaceX’s Boca Chica facility and block all further Superheavy/Starship launches.

The area surrounding the SpaceX facility at Boca Chica is a biologically diverse and essential habitat area for many species, including federally protected wildlife and animals that are considered sacred to the Carrizo/Comecrudo People, such as the critically endangered ocelot. The SpaceX facility is smack in the middle of publicly owned conservation, park, and recreation lands, including a National Wildlife Refuge, two State Parks, a State Wildlife Management Area, and a State Coastal Preserve. These lands are of extraordinary conservation value for a range of federally and state lists wildlife and other protected species such as migratory birds. Bird species from both the Central and Mississippi flyways converge there, making it an essential wintering and stopover area for migratory birds as they move north and south each year.

SpaceX activities authorized in the FONSI/ROD [the environmental reassessment issued last year] have and will adversely affect the surrounding wildlife habitat and communities. In addition to harm from construction activities and increased vehicle traffic, rocket launches result in intense heat, noise, and light pollution. Furthermore, the rocket launches and testing result in explosions which spread debris across surrounding habitat and cause brush/forest fires — including one that recently burned 68 acres of adjacent National Wildlife Refuge. The FAA calls these explosions “anomalies,” but in fact they occur frequently, with at least 8 over the past 5 years. FAA acknowledged that many more such “anomalies” are expected over the next 5 years. The U.S. Fish and Wildlife Service has found that prior SpaceX rocket explosions harmed protected wildlife and designated habitat in violation of the Endangered Species Act (ESA).

In other words, rockets and launch sites should never be placed inside wildlife refuges, because such activity is detrimental to wildlife.

A more false statement cannot be made. Under this conclusion the launch facilities at Cape Canaveral, which have been operating in the middle of a wildlife refuge now for more than six decades, should be shut down immediately. All the wildlife there must certainly be dead!

With the federal bureaucracy gleefully sharpening its knives to shut down Boca Chica, SpaceX should quickly shift Starship/Superheavy operations to Florida

The results of the spectacular test launch last week of SpaceX’s Superheavy/Starship heavy lift rocket was predictable in almost all ways.

First, everyone knew that it was highly unlikely that the launch would do everything intended. This was the first time ever that SpaceX had fired all 33 Raptor-2 engines at the base of Superheavy, at full power. It was the first time ever that this firing took place with Starship stacked on top. It was the first time ever that the entire stack was fueled. It was the first time ever that this rocket — the world’s most powerful (twice as powerful as the Saturn-5 and about three times more powerful than SLS) — had every launched.

The number of unknowns were gigantic, which was exactly why SpaceX needed to do the launch. The company’s engineers needed to find out what they didn’t know about Superheavy in order to refine their engineering so that Superheavy will be more likely for success in its next launch. They also needed to find out what such a launch would do to their preliminary launchpad, in order to refine its engineering as well so that future launches could take place with little or no damage.

Thus, it is not surprising that there were surprises. The most significant was the actual amount of success. Superheavy functioned far better than anyone could have dreamed, retaining flight control through max-q and then flying for almost three minutes before Starship failed to separate and the entire stack lost control and had to be destroyed. Most of its engines worked, though discovering the reasons for the handful that failed will be a prime question in the subsequent investigation.

The second unsurprising thing about this launch is the reaction of the federal bureaucracy, run by Democrats and the Biden administration. It has quickly moved in to squelch any further launches at Boca Chica, likely for a considerable time. The FAA immediately initiated its own investigation while grounding all further launches from Boca Chica. The Fish & Wildlife Service has now begun detailing, almost gleefully, the amount of ground damage the launch caused, including ripping out the concrete base below the rocket and flinging chunks of debris hundreds of feet away as well as depositing a cloud of sand dust on everything up to 6.5 miles from the launchpad.

Starship launch still stalled by FAA

According to a tweet by Elon Musk today, Starship will be ready for its first orbital test launch in a few weeks.

Musk also noted however that SpaceX is still awaiting the FAA’s launch license, and because of this he now expects the launch in the third week in April.

Why it is taking months for the FAA to issue this license is disturbing, and suggests that under the Biden administration the feds are behaving more and more like the incompetent Civil Aviation Authority in the UK, which stonewalled Virgin Orbit’s launch for months so that the company now sits on the verge of bankruptcy.

Pushback: Smithsonian ordered to no longer violate the First Amendment

Pushback: The Smithsonian Institution, which runs the Air & Space museum as well as other museums in Washington, D.C., has been ordered by the courts to stop violating the First Amendment, as it did when on January 20, 2023 it harassed and ejected students from a pro-life group, there as part of their participation in the annual March for Life demonstration, because they were wearing wool caps that said “pro-life” on them.

According to the consent order [pdf], the Smithsonian expressed “regret” for the event and promised to “remind all security officers stationed at NASM [National Air & Space Museum] of the rights of visitors.”

The order however does not simply accept the museum’s expression of regret. It specifically enjoins the Smithsonian and its employees “from prohibiting visitors to the Smithsonian’s National Air and Space Museum from wearing hats or other clothing with messages, including religious and political speech” and requires it to distribute the consent order to “all security officers stationed at NASM, as well as other Smithsonian personnel who interact with the public, including volunteers and museum staff, within 7 days.” It also orders the museum to tell its security officers that their behavior on January 20th was wrong.

Space startups get their SVB assets back when Feds move in

Because of the decision of the federal government to guarantee all deposits at the failed Silcon Valley Bank (SVB), even those above the $250K limit set by the FDIC law, several space rocket startups are no longer threatened with failure, for now.

Astra for example is now seeking to move as quickly as it can its assets, equaling about 15% of the company, to other financial institutions.

I would expect this incident will cause every company to make sure their assets are distributed more widely, as a hedge against the failure of one bank.

In May 2021 President Biden signed an executive order [pdf] requiring federal agencies to make climate change and helping “disadvantaged communities and communities of color” a major priority in all their work.

That executive order, which in many ways was simply a rewording of Alexandria Ocasio-Cortez’s communist and bigoted Green New Deal, required agencies to do things like reconsider where their pension funds were invested and to change those investments — not to get the best return on the dollar as required by law — but to protect them from “the threats of climate-related financial risk.”

The executive order also demanded that the Federal Acquisition Regulatory Council (FARC) require federal contractors to:

…publicly disclose greenhouse gas emissions and climate-related financial risk and to set science-based reduction targets; and (ii) ensure that major Federal agency procurements minimize the risk of climate change, including requiring the social cost of greenhouse gas emissions to be considered in procurement decisions and, where appropriate and feasible, give preference to bids and proposals from suppliers with a lower social cost of greenhouse gas emissions.
