The Holder Justice Department is under legal attack from several fronts. Holder’s effort to block all investigations, from Fast and Furious to the IRS scandal, will be revealed quite soon in court, and when it does, he is going to be toast. Better he leave now then be forced to resign at a time not of his choice. As Morrissey notes,
Resigning now allows Obama to appoint a replacement soon, and Senate Democrats to schedule the hearings during the lame-duck session (and don’t forget Harry Reid’s rule change on filibusters for presidential appointments, too, which expires at the end of this session).

I bet the whole time he is resigning he will have his Presidential Pardon clutched in his grubby little hands,
Perhaps his office accidentally calling Issa’s office to purposefully leak documents also has something to do with it.
I believe, and I may be mistaken, that pardons can only be given to those who have been convicted of a crime. What the presidents calls a pardon is actually “Amnesty” like 007 having a “license to kill”. It’s admission to being above the law. This is very controversial a nation that believes in the rule of law… Or used to be.
I am trying to stay optimistic that this is a good thing. And then I remember Eric’s favorite statement, “NEVER LET A CRISIS GO TO WASTE”
I would not be surprised if there’s an opening on the Supreme Court very soon…
It wasn’t Holder; it was Rahm Emannuel, the former White House chief of staff. But it is likely Holder adheres to the same philosophy.
A Supreme Court nominee? I think not, a recipient of a Fast And Furious subpoena or indictment more likely in the shadow of a judge ordering the release of documents in the next 21 days that that the administration has refused to surrender claiming executive privilege related to the case.
Refresh your memory about what the government actively did in the Fast And Furious operation, they apparently conspired (forced) legal gun dealers to release working high powered weapons to known bad guys in straw purchases without a way to track or retrieve them in an apparent attempt to drive the Second Amendment / gun control conversation in the country. This irresponsible (read treasonous) plan to usurp the Constitutional rights of American people resulted in the deaths of boarder agents and probably many more unknowns. And who apparently hatched this plan? The current Attorney General?
We will soon see.
Ford granted Nixon a full and unconditional pardon before he was indicted.
No need for convictions.
I do believe amnesty is given before the incident and a pardon is granted after.
If he had amnesty (and declared it)then that alone is proof that the Prez knew he was about to commit a crime.
