Pushback: Class action lawsuit against NY’s racial discriminatory COVID policy

The Democratic Party: “Segregation today, segregation tomorrow, segregation forever!”

William Jacobson, the founder of the website Legal Insurrection, has filed a class action lawsuit against New York State’s policy of providing COVID medical treatment not based on health factors but on race.

The suit is specifically against Mary T. Bassett, the Acting Commissioner of the New York Department of Health.

Essentially, Bassett and New York have established the same bigoted policies that have been instituted in states like Texas and Vermont that favor blacks and minorities over whites in determining who should get certain COVID treatments first. Based on the state’s racial criteria, a completely healthy 25-year-old black man would be favored over a 45-year-old white man, even though the latter is at much greater risk of death from COVID.

As stated in the complaint [pdf]:

Using a patient’s skin color or ethnicity as a basis for deciding who should receive lifesaving medical treatment is appalling. And directing medical professionals to award or deny medical care based on immutable characteristics such as skin color, without regard to the actual health condition of the individual who is seeking these antiviral treatments, is nothing more than an attempt to establish a racial hierarchy in the provision of life-saving medicine. Worse still, New York’s racial preferences ignore the obvious race-neutral alternative policy of making antiviral treatments available to patients of any race who can demonstrate risk factors, such as advanced age, obesity, a compromised immune system, or other medical conditions.

The lawsuit specifically names Jacobson as a victim, since New York’s policy would refuse him treatment if he should get the Wuhan flu, simply because he is white and could likely not show any serious medical issues beyond COVID. Because this is a class action suit others who are white and thus denied healthcare by New York for racial reasons can join the suit as well as plaintiffs.

The lawsuit notes that New York’s policy violates the fourteenth amendment to the Constitution (which demands equal treatment before the law), the Civil Rights Act of 1964 (which bans racial and ethnic discrimination), and Obamacare (which also forbids refusing anyone treatment based on their race or ethnicity).

Jacobson is being supported in his lawsuit by American First Legal.

Voters: Please note that New York is controlled entirely by the Democratic Party. Though for decades this party claimed it was a champion against discrimination, we now know that its real agenda was always for creating a racially-bigoted system that would favor minorities. In other words, the Democratic Party has returned to its KKK roots, but instead of supporting segregation against blacks and other minorities, it now supports segregation against whites.

It is time to throw these racist and bigoted Democratic Party bums out of power, everywhere.

    1. First thing Joe does, opens the Southern borders and incentivizes over 2 million illegals to come to America. (Why did he do that? Do you know?)
    2. Joe shut down the Keystone pipeline. (Joe purposefully weakens America’s ability to produce energy)
    3. Joe approves the Russian Nord Stream 2 pipeline to Germany. (Joe empowers and enriches Russia)

    4. Counterintuitive government policies have caused growing inflation and massive increases in the cost of energy and food.
    5. Joe and the Democrats attempt to mandate an experimental “vaccine” for most Americans, or you lose your job.
    6. No person crossing the border illegally is either checked for Covid or is mandated to be “Vaccinated” and is flown into the country.
    7. Because of perceived incompetence and weakness in the White House both Russia and China are positioning to take what they please.
    8. It is clearly established that the president through his son Hunter is compromised financially and has obligations to both China and Russia.
    9. The Democrat leadership and the president pushes constantly that America is fundamentally racist. (Are you fundamentally racist?)
    10. The Democrat leadership and the president are attempting to un Constitutionally Federalize elections in order to control and determine their results.

    The Democrat party machine and Joe are purposefully destroying the America that you know and love. Why do you think that is? Do you think what is going on is in your or your country’s or your family’s best interests?
