Democrats pick Pelosi again

Nancy Pelosi has fought off a challenge to her position as the House Democratic leader, winning 134 to 63.

Considering how badly the Democrats have fared in elections under her leadership, her victory here indicates strongly the bankrupt state of the Democratic Party. They seem unable at all to accept any blame for their losses, which would be the first step in reforming their increasingly corrupt party. Instead, they have been doubling down on the same rejected leftwing and race-based policies. Note also how the Democratic Party has become entirely dominated by its urban and coastal regions. While those areas have become almost one-party states run unopposed by the Democratic Party, their influence is very regionally limited and has been strongly rejected by most of the rest of the country. Even so, the Democrats continue to pick as their leader an extreme leftist from the extremely leftist San Francisco area.

None of this bodes well for either the Democratic Party, or the nation on the whole. To have a healthy democracy you need a healthy opposition party. Right now we do not have it.

The science lobby looks at Trump’s pick for Health Secretary

Link here. The Nature article clearly takes a partisan and opposition view of Trump’s pick, Congressman Tom Price (R-Georgia). Nonetheless, it does give good insight into Price himself. I especially like this quote, used by Nature to imply that Price is somehow hostile to science:

But Price’s stance on biomedical research issues is harder to parse. He has taken few public positions on science, but has consistently pushed to cut overall federal spending. Last year, he voted against a bill that would overhaul FDA regulations and provide US$8.75 billion in mandatory funding to the NIH over five years.

Price also opposes President Barack Obama’s proposed $755-million Cancer Moonshot, which seeks to double the pace of cancer research over the next decade. “We’re all in favour of increasing funding for cancer research,” Price told STAT News in January. “The problem that the administration has is that they always want to add funding on, they never want to decrease funding somewhere else. That’s what needs to happen.” [emphasis mine]

There was once a time where Price’s approach would have been considered plain common sense. In today’s mad leftwing world however the idea that resources are not unlimited and that people have to make careful choices is considered evil and anti-science.

Expect these kinds of attacks to continue nonstop throughout the entire Trump administration, especially if that administration and Congress continue to push for a bit of restraint on budget issues. This is what happened during Reagan’s first term in the 1980s. The result was that eventually Reagan was never able to trim costs or eliminate any federal agencies, as the attacks caused many of his more radical cabinet picks to resign and the Republicans in Congress to eventually back down.

Today, however, things are different in one major way. Then, there was no alternative to the liberal press. Today, there are such alternatives. Moreover, the bias of the liberal press today is much more evident. Many more people recognize it, and do not take their howls of indignation as seriously. If Trump and the Republicans have some courage and do not back down, they can win this battle. All it will take is some courage. We shall see if they have it.

Trump and the Republican establishment team up

The House Republican majority leader Kevin McCarthy (R-California) today said that their partnership with Trump will allow them to ignore the conservative Freedom Caucus.

Majority Leader Kevin McCarthy signaled that Republican brass doesn’t plan to kowtow to the conservatives anymore. Ryan’s No. 2 predicted that it’ll finally be the other way around. The group will be forced to fall in line. During a forum hosted by The Washington Post, McCarthy forecasted a less influential Freedom Caucus, a bolder GOP leadership team, and a more unified GOP conference. Altogether, the California Republican explained, “you’re going to see us sticking together more.” That’d be a significant change from the last two years.

…Famous for making deals, Trump won’t worry about reaching across the aisle to compromise with Democrats. For the pragmatic president-elect, bipartisanship is a bonus, not a liability. The threat of losing 35 members of the Freedom Caucus won’t fill Trump’s White House with fear. Depending on the significance of the legislation, Trump won’t have much trouble getting his agenda through the House. Democrats have already signaled that they’re ready to work with the new administration. They won’t hesitate to jump onboard a trillion-dollar infrastructure package or a protectionist trade deal.

I am not surprised. I do feel bad for all those conservatives who went with Trump instead of Cruz because they imagined him first as an “outsider” instead of the moderate Democrat that he is.

Trump picks pro-voucher conservative for Education Secretary

President-elect Donald Trump has chosen Betsy DeVos, a wealthy pro-voucher Republican activist, to head the Education Department.

Her record puts her dead center within establishment Republican Party circles.

In related news, Trump has chosen Elaine Chao as Transportation Secretary. Chao was previously labor secretary in the last Bush administration, and also happens to be the wife of Senate Majority Leader Mitch McConnell. Once again, someone deeply linked to the establishment Republican Party.

At the same time, both picks have strong links to the very conservative Heritage Foundation.

Autistic boy disqualified from victory because he swam too fast

Madness: A nine-year-old autistic boy was denied a gold swimming medal in a special Olympics competition in Wales because he set a personal best time that was more than 15% better than his previous best.

Rory Logan, nine, was competing in the Special Olympics Regional finals in Bangor, north Wales, and won the 50 metres race in 53.15 seconds – a personal best and smashing his heat time of one minute and three seconds. However, when it came to the medal ceremony, Rory, from County Antrim, was simply given a ribbon for participating instead of the gold he was expecting.

Now mum Briony claims that officials told her that he didn’t get a medal because he was too fast for the race. She told Belfast Live: “Rory came to me and said, ‘Mum I didn’t do anything wrong, I won fair and square, what did I do?’. I was absolutely gutted for him. I went to speak to the officials and basically they said he had been disqualified because he swam too fast. No one can get over this decision. Apparently you can’t be more than 15% faster than the time you swam in your heats just in case you are trying to swim slower in your heat to be placed in a lower division’s final.”

The boy went on to win gold in two other races, for which he should be cheered, but that he was denied a medal because he did his best is beyond disgusting.The worst part of this story is that in the future this kid is likely going to sandbag his achievements in order to avoid getting punished for success.

New Defense directive permits concealed carry on bases

Change: A new Department of Defense directive, issued last Friday, now permits soldiers and recruiters to carry concealed weapons while at work.

U.S. military personnel can now request to carry concealed handguns for protection at government facilities, according to new Defense Department directive issued last week in response to a series of deadly shootings over the last seven years. While service members already were authorized to carry weapons as part of specific job responsibilities, the new policy allows them to apply to carry their privately owned firearms “for personal protection not associated with the performance of official duties,” the directive says.

It is interesting that this directive was issued while Obama was still president. Apparently, the Trump victory gave those in charge in the Pentagon the courage to make it happen, knowing that Obama would have no power over them stop it, and knowing that Trump was likely to endorse it.

I remain unsure what kind of president Donald Trump will be. What does seem to be happening is that his victory is empowering a lot of people to defy and push back against the leftwing political culture that has ruled the U.S. since the 1960s in ways I have never seen. Should be an interesting four years.

A lawsuit that could end all federal gun regulations

Link here. The case is new, and involves the manufacture of guns by a private citizen wholly within a single state. He was convicted of violating federal laws, even though the state itself, Kansas, had recently passed a law that specifically outlawed federal prosecution for anyone “owning firearms made, sold and kept in the state.”

The only federal challenge to the constitutionality of National Firearms Act to date was U.S. vs Miller in 1939, which was uncontested when neither the defendant nor his attorney showed before the federal court. As a result, we’ve never had these federal gun laws challenged on the fundamental level.

If Cox and Kettler’s attorneys see this challenge through the courts, we can expect it to arrive before a U.S. Supreme Court in several years time. It will be a high court shaped by the 45th President of the United States, Donald Trump, and the organization that spent more money than any other to help him win the Presidency, the National Rifle Association.

Judge blocks illegal Obama overtime rule

The law is such an inconvenient thing: A federal judge today blocked an Obama administration rule that tried to unilaterally extend overtime to millions of workers, without any legal basis.

U.S. District Judge Amos Mazzant in Sherman, Texas, agreed with 21 states and a coalition of business groups, including the U.S. Chamber of Commerce, that the rule is unlawful and granted their motion for a nationwide injunction. It was to take effect Dec. 1. The rule would have doubled to $47,500 the maximum salary a worker can earn and still be eligible for mandatory overtime pay.

The states and business groups claimed in lawsuits filed in September that were later consolidated that the drastic increase in the salary threshold was arbitrary. Mazzant, who was appointed by President Obama, held that the rule runs counter to the federal law that governs who is eligible for overtime. The law does not allow the Labor Department to determine eligibility based only on salary levels, Mazzant said.

This behavior by the Obama administration is pretty par for the course. What do they care what the law says? They are wise and educated Ivy-League liberals who know better. They have the right to impose their will on everyone else, without any restrictions.

The worst fake news stories in the past few decades

And these faked stories are all from the mainstream leftwing press, CBS, NBC, New York Times, Rolling Stone, Washington Post, New Republic, and MSNBC.

The NBC corporation is an especially bad player here. Worse, their behavior has been specifically aimed at fueling a race war. In one case, they claimed that the Tea Party movement was made up of white racists and thus dangerous to blacks, and to prove it they showed an image of the rifle slung over the back of a Tea Party protester. The trouble was that they specifically framed the image to hide the fact that the protester was black. Then NBC deliberately edited the recording of George Zimmerman’s conversation with 911 to make him sound racist. It was a lie, as were all these stories.

What makes NBC the worst is that they have made no effort to fix the problem. They not only haven’t punished or fired anyone, they keep doing it again and again.

For this network or any of these mainstream leftist outlets to now complain about “fake news” is the height of absurdity. What they are really doing is trying to discredit alternative news sources that have actually been reporting the news better than them. They don’t like the competition, both financially and politically.

Massachusetts college bans American flag

Madness: Hampshire College in Massachusetts has decided to ban the flying of all flags, including the United States flag, in order to avoid offending anyone.

Their problems began when they lowered their American flags to half mast to protest the election results. Then they let someone remove a flag and burn it. Faced with a storm of criticism they have decided to punt, which I think will do them even more harm. I would not be surprised it alumni donations dry up, as well as student applications.

Democrats look in all the wrong places to explain their losses

The Democratic Party is attempting to analyze the recent election to try to find out what has been causing their significant losses in order to prevent further election defeats and bring about a recovery.

Not surprisingly, they are blaming everything and everybody but their own policies.

Party insiders are reluctant to blame the popular Obama but cite plenty of reasons for the decline. These include a muddled economic message; an overemphasis on emerging demographic groups such as minorities and millennial at the expense of white voters; a perception the party is elitist and aligned with Wall Street; a reluctance to embrace the progressive populism of Senator Bernie Sanders, the former presidential hopeful; and failure to field strong candidates in key states.

There is an emerging consensus, they add, that the party has been too focused on winning national races and has not invested enough in local campaigns, along with a grudging admission that Republicans have done a better job of competing on the ground. [emphasis mine]

The highlighted text above shows how completely divorced from reality this Democratic Party continues to be. Most of the country rejects socialism, and it was the Democratic Party’s increasing tilt towards socialism that is hurting it badly and caused it lose control of almost all the state legislatures nationwide.. Do they recognize this? Absolutely not. Instead they want to become more socialist.

Moreover, most of the other reasons they cite for their losses either blame outside forces (such as Republican efforts to require an ID to vote) or poor messaging. It is never anything they did, such as impose Obamacare and run the government badly.

Moreover, that the Democrats continue to increase their dominance in the big urban areas should not be used by them as a sign that their policies are right. The big urban areas are also generally places with the worst quality of life, the most crime, the worst poverty, and biggest government deficits. Even if the citizens in those places can’t see how badly they are being ruled by Democrats, the rest of the country does. Moreover, it will be impossible for the Democratic Party to recover significantly as long as it relies solely on the voters in these concentrated urban areas. To get the rest of the country to consider them worth voting for again they are going to have to face their own policy failures and change direction. Sadly, I see no evidence that they are going to do this.

Obamacare Medicaid expansion to overwhelm state budgets

Finding out what’s in it: The 24 states that have accepted the Obamacare Medicaid expansion are about to have their budgets overwhelmed by the much larger numbers of enrollments in that program than was expected.

Obamacare’s Medicaid expansion makes working-age adults with no kids and no disabilities eligible for a welfare program that was costly and ineffective long before Obamacare. The 24 states with a year or more of data available expected no more than 5.5 million would ever sign up, but their expansion enrollment is already 11.5 million – more than double its projected all-time maximum.

Alaska, Indiana, Louisiana, and Montana have not yet released a year of enrollment data, but have all reported Obamacare expansion enrollment higher than their expected maximums, FGA vice president of research Jonathan Ingram and FGA senior research fellow Nicholas Horton noted. “Medicaid expansion already makes welfare for able-bodied adults a higher priority than services for the nearly 600,000 seniors, children with developmental disabilities, individuals with brain injuries, and other vulnerable individuals currently languishing on waiting lists for needed Medicaid services,” Ingram and Horton wrote. “Mounting overruns will soon exacerbate pressure on policymakers to shift even more money away from the truly needy and towards ObamaCare’s able-bodied adults.”

Obamacare expansion benefits are 100 percent federally funded through the end of the calendar year, which has shielded states from billions of dollars in cost overruns since expansion took effect in January 2014. That will soon change. If Obamacare remains in place, states will be on the hook for five percent of their rapidly rising Medicaid expansion costs starting in January. And if President-elect Donald Trump and Republicans in Congress fulfill campaign promises to repeal Obamacare, federal funding for Medicaid expansion could be cut off in a matter of months.

On this issue, at least, there is precedent for congressional Republicans sticking to their word. Last January, President Obama vetoed an Obamacare repeal bill that would have ended Medicaid expansion.

Even if Obamacare is not repealed, these states still face serious budget problems because the cost of this program is, like everything else in Obamacare, far higher than predicted. If Obamacare is repealed, then these states face bankruptcy.

NASA global warming advocate Gavin Schmidt fights back

The head of NASA’s Goddard Institute of Space Studies (GISS), Gavin Schmidt, declared in a newspaper interview on Thursday that “Global warming doesn’t care about the election.”

The science community and environmental campaigners in the US have already begun efforts to persuade Mr Trump that climate change is actually real before he takes office next year. Dr Gavin Schmidt, the director of Nasa’s Goddard Institute for Space Studies, signalled they would have allies among the federal science agencies. He tweeted a graph including new data from Nasa showing that last month was the second warmest October on record, putting 2016 firmly on course to be the warmest year. “No surprise here, planetary warming does not care about the election,” he wrote.

I would not be surprised if Schmidt ends up getting fired by Trump. His monthly graphs showing each month to be the hottest on record, such as the one he tweeted in the quote above, have been absurd campaigning, not science. For one thing, the differences from month to month have been in the hundredths of a degrees, well within the margins of error and essentially insignificant in value. To claim that his data has determined the “hottest” month on record from this is demonstrating that he is not a scientist, but a political activist.

Gavin Schmidt vs the satellite data

Secondly, his data is not trustworthy to begin with. Schmidt has been in charge of all of the data tampering at NASA that has consistently altered the decades-old surface temperature record — without any clear scientific justification — to cool the past and warm the present so that the amount of warming is emphasized. While his graphs show the climate to be warming, based on surface data that he has been adjusting, the satellite data that NASA gathers that he (a NASA scientist) generally ignores, does not. The image to the right illustrates this, and shows that the divergence between his adjusted surface data and the satellite data has been increasing steadily over the years.

I fully expect Schmidt and the other global warming scientists in NASA and NOAA to team up with the press, as Schmidt does here, to defy Trump. Whether Trump will have the courage to fight back, something no Republican has been willing to do for decades, will be the key question.

“You are still crying wolf.”

Link here. This essay sums up the bankrupt intellectual American community — so partisan Democratic that they have lost all sense of honor or dignity — probably better than anything I have read in decades. And it was written by a person who dislikes Donald Trump strongly, but for very thoughtful and reasonable reasons. As he pleads in conclusion,

Stop fearmongering. Somewhere in America, there are still like three or four people who believe the media, and those people are cowering in their houses waiting for the death squads.

Stop crying wolf. God forbid, one day we might have somebody who doesn’t give speeches about how diversity makes this country great and how he wants to fight for minorities, who doesn’t pose holding a rainbow flag and state that he proudly supports transgender people, who doesn’t outperform his party among minority voters, who wasn’t the leader of the Salute to Israel Parade, and who doesn’t offer minorities major cabinet positions. And we won’t be able to call that guy an “openly white supremacist Nazi homophobe”, because we already wasted all those terms this year.

Read it all. He illustrates the unwillingness of the modern left (that dominates the academic community, the mainstream press, and the urban cities) to deal in actual facts. Instead, they scream vicious lies against every Republican candidate and thus make it impossible to have a sane conversation.

Ryan stops vote on earmarks

House speaker Paul Ryan (R-Wisconsin) was today able to convince Republicans to delay a vote on reinstating earmarks.

Ryan convinced his colleagues to postpone the vote until the first quarter of 2017. “After a long debate, it was clear there’s a lot of pent up frustration with ceding spending authority to the Executive Branch,” said one source in the room. “Based on the comments by members, it was likely that an earmark amendment would have passed. Ultimately, the speaker stepped in and urged that we not make this decision today.”

“[Ryan] said we just had a ‘drain the swamp’ election and cannot turn right around and bring back earmarks behind closed doors,” the source continued.

Be warned. This issue is not dead. The crooks in Congress on the Republican side have simply agreed to delay the vote in the hope that after things calm down in a few months they can slip it in without anyone noticing.

The American city-rural political divide

Though the article at the link focuses on how in this year’s election the Democratic Party has lost its traditional support from white blue collar Democrats, I think it illustrates quite forcefully the increasing political polarization between the cities and the rural parts of the country.

“There are 490 counties in Appalachia technically, which is defined by federal law. Hillary Clinton won 21 counties in that region,” he said. And that is it. She did not win a single county in Appalachia that is mostly white, non-college-educated and has a population of under 100,000 people.

Not one county.

Looking at the map, the 21 counties she won were either college campuses like Virginia Tech, Cornell, Penn State and Mississippi State or counties in major metropolitan areas like Atlanta, Birmingham, Ala., Winston-Salem, N.C., Youngstown, Ohio, and Pittsburgh. And she also won five counties in Mississippi that are nearly majority black. “I went back and looked at the home precinct in Tennessee where I grew up and Bill Clinton wins it, Al Gore gets forty percent, Obama gets 28 percent and she got 18 percent. In short, Donald Trump got 80 percent of that vote,” he said, astounded at the cultural shift among Appalachians.

What does all of this data tell you about America? Todd says it is simple, “There are absolutely no more blue-collar whites in the Democratic Party. They just don’t exist, even the ones who want there to be have recognized there is no room for them,” he said. These voters had stayed with the Democrats forever and now 80 percent of them in Appalachia have voted Republican. “That means they don’t know anyone who voted for her,” he said.

This polarization also explains why it is becoming more common for the choice of the electoral college to not match the popular vote. Democratic voters are increasingly packed into big cities that cover very small amounts of area. The electoral college as well as Congress were specifically designed to prevent such concentrations from dominating elections.

These results also show that the Democrats are not doing a very good job convincing anyone to vote for them outside of their reliable core constituencies. In fact, if anything the policies of the Democratic Party has been repelling everyone away from it, except in those big cities where a large percentage of the voters are their direct welfare clients, dependent on government aid.

Nebraska bans civil forfeiture without a criminal conviction

Good news: A Nebraska law passed and signed in April has banned the police from confiscating any private property prior to a criminal conviction.

Now that the Nebraska bill has been signed into law, innocent property owners will have some rather significant new protections, the most significant of which is the requirement for a criminal conviction. Believe it or not, under civil forfeiture laws, no convictions need to be obtained—nor even any charge filed—to permanently forfeit property. Nebraska’s decision to require a conviction essentially eliminates civil forfeiture in the state.

The state may still forfeit property, but only after obtaining a conviction on drug, child pornography, or illegal gambling charges, and then only after demonstrating by clear and convincing evidence that the property in question was used or intended to be used in the commission of the crime, or that it represented the illicit “fruits” of the criminal activity.

The law was passed back in April but I missed the story. Hat tip to reader Tim Vogel for letting me know.

TMT legal case in Hawaii gets messier

The permit process in Hawaii for the Thirty Meter Telescope has gotten far messier, with the telescope’s opponents appealing to the state’s Supreme Court, complaining about witness procedures and the lawyers who are working for the state, while the land board running the procedures has asked the court to dismiss this appeal.

Essentially, the opponents are using every trick in the book to delay the permit process, and it appears that the law in Hawaii, including one just passed in August, is designed to aid them in this tactic.

TMT will not be built in Hawaii.The consortium that is building it needs a decision by early next year at the latest. They ain’t gonna get it. The luddites going to win, and Hawaii will be far poorer because of it.

House passes new tax on concrete companies

The swamp is winning! The Republican House today passed a new law that not only imposes a new tax on concrete industry, it creates a crony Concrete Masonry Products Board to help keep its buddies in that industry in charge.

The bill, introduced by Rep. Brett Guthrie, R-Ky. (F, 45%), would create a Concrete Masonry Products Board composed of 15-25 members appointed by the Department of Commerce after a referendum approval by producers of concrete masonry products. This board will have the power to establish, finance, and carry out a “coordinated research and education program,” ostensibly to “promote masonry products in the domestic market,” according to a legislative bulletin email from the Republican Study Committee. This program will be paid for by a “federally administered assessment.”

This is corruption, pure and simple. We don’t need this. All it accomplishes is to force the public to pay for this fake board whose only real purpose, when you strip it down to its essentials, will be to favor the already established U.S. concrete companies.
