[O]n June 4, DOJ told the committee that its prior assurance was inoperative: the disks actually include confidential taxpayer information that was give to the FBI in violation of federal law. This is a serious matter; violation of the applicable statute carries a penalty of five years in prison.

The obvious inference is that the IRS didn’t just send the FBI a bunch of publicly available Form 990s filed by non-profits. Rather, the IRS included Schedule B to those forms–the documents that name the organization’s donors, and provide their addresses and the amounts they contributed. Donor information contained in Schedule B is confidential. Illegally communicated, it would give the FBI a checklist of individuals who could be investigated and potentially criminally prosecuted, much as Dinesh D’Souza was prosecuted for a chickenfeed election offense a few years later.

But don’t worry, there’s not a “smidgen of corruption” according to Obama in this IRS scandal.

Andrew Lampart, a senior at Nonnewaug High School, discovered that he couldn’t get on the National Rifle Association’s website while on campus as he was doing research for a classroom debate on gun control in May. “So, I went over to the other side,” Lampart told WTIC. And I went over on sites such as Moms Demand Action or Newtown Action Alliance and I could get on these websites but not the others.”

The 18-year-old decided to investigate further by broadening his search terms to political parties in Connecticut. “I immediately found out that the State Democrat website was unblocked but the State GOP website was blocked,” Lampart said. The student took it a step further and looked at websits focusing on abortion issues and religion. He discovered that “right-to-life” groups were blocked by the firewall but that Planned Parenthood and Pro-Choice America weren’t. Lampart even tried to explore websites like Christianity.com and the Vatican’s site but they were both blocked. However, Islam-guide.com was not blocked. “They’re trying to, in my opinion, shelter us from what’s actually going on around the country and around the world by blocking these web sites,” Lampart explained. “It should be the other way around. The websites should be unblocked so that students can get different viewpoints from different sides of each argument.”

The superintendent of Woodbury schools was notified by Lampart, but nothing was done to fix the problem after a week. He decided to take his concerns to the Board of Education on Monday.”

The lack of action by his superintendent I think proves that this partisan blocking was not an accident but was entirely intentional. But remember, the left is the tolerant and open-minded movement!

No apologizes from the Massachusetts authorities, who seized the girl against the wishes of the parents and her Connecticut doctors and held her almost literally in prison while they imposed their preferred medical treatment. It is unclear from the article whether the treatment by the Massachusetts doctors has worked, or whether they have discovered they were wrong. In either case, they were fascists to kidnap the girl as they did. One more reason to stay away from this oppressive area of the country.

Is the Sun’s strange double-peaked solar maximum finally ending?

Last week NOAA posted its monthly update of the solar cycle, showing the sunspot activity for the Sun in April. As I do every month, I am posting it here, with annotations to give it context.

The graph above has been modified to show the predictions of the solar science community. The green curves show the community’s two original predictions from April 2007, with half the scientists predicting a very strong maximum and half predicting a weak one. The red curve is their revised May 2009 prediction.

For the third month in a row the Sun continued its drop in sunspots, with the total finally slipping below the 2009 prediction for this moment in the solar cycle. If this decline continues through to solar minimum, the shape of the solar maximum will essentially have been established, double-peaked with the second peak stronger than the first, something that solar scientists have never seen before.

At the moment I await word from the scientists that the Sun has completed the flip of its magnetic field polarity in the southern hemisphere. This flip has already occurred in the northern hemisphere, and when the south follows, the maximum will be officially over and we will officiallybegin the ramp down to solar minimum.

The Internal Revenue Service says it can’t produce e-mails from six more employees involved in the targeting of conservative groups, according to two Republicans investigating the scandal.

The IRS told Ways and Means chairman Dave Camp and subcommittee chairman Charles Boustany that computer crashes resulted in additional lost e-mails, including from Nikole Flax, the chief of staff to former IRS commissioner Steven Miller, who was fired in the wake of the targeting scandal.

How convenient: These six employees just happened to have computer crashes destroying these key emails.

I’ve reported on this project before. The idea is laudable but the implementation has been nothing but pure pork. Fourteen years and a billion dollars merely to design the study? As I’ve said for the past two years, the high cost and slow development of SLS will increasingly make it a loser in its political battle with the new commercial companies. Eventually legislators will recognize its impractically and unaffordability — especially if the commercial companies continue to meet their milestones and achieve success, as they have been doing. When that happens, the influence of individual senators like Shelby to shovel pork to their particular states or districts will be outweighed by the overall political benefits for everyone in Congress to get American astronauts into space quickly and cheaply on an American-built spaceship.

This editorial by a major newspaper signals the continuation of this political process.

The article is interesting in that it is somewhat critical of SpaceX’s overall failure so far to meet its launch manifest schedules. The point is well taken, but it seems to me that most of the delays were related to getting the upgraded Falcon 9 into operation. Now that this has happened, I expect SpaceX’s launch rate will continue to accelerate.

The commercial contracts between ULA and prospective U.S. engine builders cover technical feasibility analyses, high-fidelity planning, schedule, cost and technical risk assessments, and cost estimates, ULA said in a statement released Monday. … ULA did not identify which companies will undertake the engine studies. Jessica Rye, a ULA spokesperson, also declined to say how many companies signed the contracts with the launch provider. The contracts are for early-stage studies of a hydrocarbon-fueled engine optimized for first stage propulsion with “aggressive recurring cost targets,” according to ULA.

All the engine concepts will support a first launch by 2019, and ULA expects to select a future concept and engine supplier by the fourth quarter of this year, the company said. ULA will evaluate the feasibility of the new engine concepts for both private investment and the potential for government-industry investment.

For the American rocket industry this is good. The only negative I can see is the possibility that Congress will allocate a lot of cash and requirements for building the new engine, which will increase its cost, slow its development, and make it less competitive. If they instead do it like NASA has done with its commercial crew development and let companies compete to build it, they will get it sooner and cheaper, and the industry will develop more options.

Read it all. The legalities here are not in favor of the Obama administration and the IRS. They are very exposed. The last few paragraphs of MItchell’s letter illustrate this quite starkly:

In addition to seeking responses to the questions in this letter, we also seek your consent to immediately allow a computer forensics expert selected by TTV to examine the computer(s) that is or are purportedly the source of Ms. Lerner’s “lost” emails, including cloning the hard drives, and to attempt to restore what was supposedly “lost,” and to seek to restore any and all “lost” evidence pertinent to this litigation.

We also seek access to all computers, both official and personal, used by any and all of the Defendants from and after July 1, 2010, in order to ensure preservation of the documents of all Defendants in this action.

We wish to resolve our concerns amicably but, absent your consent, we will file such motions as deemed necessary and appropriate asking the Court to require that you respond to the questions contained in this letter, and to permit such forensic examination described herein and for such other relief as may be appropriate for this egregious breach of legal authority and professional ethics.

Due to the time-sensitive and urgent nature of this request, please respond by noon on Wednesday, June 18, 2014.

These demands are entirely legal and routine in lawsuits with circumstances such as this. Even the most partisan Democratic judges in the courts are going to find it very difficult to protect the IRS and the Obama administration here.

As was said over and over and over again during the Watergate scandal in the 1970s, it wasn’t the crime so much as the coverup that destroyed Richard Nixon. It looks like the same thing might be happening to Barack Obama.

This allocation is still contingent upon a test observation to see if Hubble will be able to spot enough objects to make the long observations worthwhile.

It’s one thing to get a political hack to lie under oath or to take a fall to keep himself viable in that world, it’s quite another to get the non political people who have no real skin in the game to be willing to perjure themselves before congress in an attempt to claim incompetence.

These guys simply aren’t going to take the fall for a bunch of political hacks.

The clock is ticking, as soon as the IT guys are under oath the IRS scandal is going to explode and that blast is going to take a lot of people with them.

The only way this bomb will go off, however, is if the Republicans in Congress light the fuse. They have to push the issue, forcing these lower level IT people to testify. Sadly, these Republicans too often act like they are afraid of their own shadow, thus letting the worst acts of corruption slip without so much as a peep.

Hopefully the results of the November election will give these guys some backbone.

The key detail in this story is not so much that they are beginning to figure out the engineering upgrades necessary to fling a Soyuz capsule around the Moon but that Space Adventures has apparantly finally gotten two passengers who have put down deposits for the lunar flight. For years they have said they had one ticket holder, suspected to be James Cameron, but without a second passenger the flight could not go forward. It now appears that they have gotten a deposit from that second person.

The companies said the joint-venture would combine Airbus Group’s launch systems with Safran’s propulsion systems, but hinted at broader integration of public and private activities in an effort to duplicate the success of planemaker Airbus. Europe’s Ariane 5 space launcher dominates the market for large commercial satellites but faces growing concerns over its future due to competition from Space Exploration Technologies (SpaceX), run by billionaire entrepreneur Elon Musk.

To respond to the threat, Airbus and Safran aim to lead a drive towards an integrated European launch firm drawing on the lessons of Airbus’s planemaking unit, which was spurred into turning itself from being a consortium into a single company by the merger of transatlantic rivals Boeing and McDonnell Douglas in 1997. The article, like practically every other report about Europe’s space effort in the past two years, singles out the competitive threat being made to their market share by SpaceX. Increasingly, the price reductions being offered by Musk’s company combined with its repeated success in launching payloads into orbit is forcing Europe to cut its own costs and become more efficent, something they have not bothered to do in decades. As result access to space is about to get signigicantly cheaper.

I have been traveling so I missed posting the original story about this absurd claim by the IRS. It is a downright lie and a coverup and should be answered with prosecutions and imprisonment.

Sierra Nevada has announced that it plans to do additional test flights in 2014 of its prototype Dream Chaser engineering test vehicle.

This is the same test vehicle that skidded off the runway during its first flight when one of its landing legs did not deploy. The company has never released any images of that smashup, but has said the craft was salvageable. I imagine this announcement is part of the continuing lobbying campaign by all the companies (SpaceX, Boeing, Sierra Nevada) competing in NASA’s commercial manned program. NASA is supposed to down select to two companies, maybe only one, by the end of the summer.

The space agency was forced to scrub six launch attempts over the past two weeks — the latest and last planned for this Saturday (June 14) — as a result of unusually poor wind conditions at the U.S. Navy’s Pacific Missile Range facility in Kauai, Hawaii. The balloon-launched Low-Density Supersonic Decelerator (LDSD) craft is intended to help NASA develop the means to land heavier spacecraft, and eventually humans, on Mars.

“All of the vehicle systems [and] our team were ready and prepared for all of the launch days; we were ready to go,” said Mark Adler, LDSD project manager at NASA’s Jet Propulsion Laboratory (JPL) in Pasadena, California. “The only thing that held us up was that none of the launch dates had or will have acceptable weather conditions.”

They have literally run out of their available time at the range, and must let others play through first while they renegotiate for a new slot of time later.

I think Trende’s analysis here is the best I’ve seen of this ongoing primary election cycle. These three paragraphs especially pinpoint why things are happening as they are:

We are in a deeply anti-Washington environment, both throughout the country and in the Republican Party in particular. In this environment, representatives who pay insufficient attention to what is going on in their districts are in grave danger of losing. There are two components to this explanation.

First, analysts need to understand that the Republican base is furious with the Republican establishment, especially over the Bush years. From the point of view of conservatives I’ve spoken with, the early- to mid-2000s look like this: Voters gave Republicans control of Congress and the presidency for the longest stretch since the 1920s.

And what do Republicans have to show for it? Temporary tax cuts, No Child Left Behind, the Medicare prescription drug benefit, a new Cabinet department, increased federal spending, TARP, and repeated attempts at immigration reform. Basically, despite a historic opportunity to shrink government, almost everything that the GOP establishment achieved during that time moved the needle leftward on domestic policy. Probably the only unambiguous win for conservatives were the Roberts and Alito appointments to the Supreme Court; the former is viewed with suspicion today while the latter only came about after the base revolted against Harriet Miers.

His second component notes that the politicians who understand this environment win, while those who do not lose. Read the whole thing. It will help clarify not only what has happened but what will happen in the coming months.

The petition drive was put together by a group called UltraViolet led by Nita Chaudhary.

Who is UltraViolet co-founder Nita Chaudhary? In 2004, she was the Democratic National Committee’s first director of online. And she is the former campaign director at MoveOn.Org. … Chaudhary is also the wife of Jesse Lee, the White House’s director of progressive media and online response.

The author then asks this blunt but totally valid question:

And so I ask a genuinely scary question: does the broader progressive movement, which includes the White House media team, believe in free speech? By that I mean the actual kind of free speech, not the increasingly common progressive view where you profess fealty to the First Amendment as an anachronistic legal technicality solely so you can deflect criticism when someone calls out your totalitarian impulses. Real free speech means a culture of free speech, where we all confront opinions that bother us, in the understanding that regularly challenging our assumptions makes us a more thoughtful, cohesive, and, yes, tolerant people.

I think we can safely conclude that Chaudhary and Lee don’t believe in the meaningful kind of free speech.

And Lee is part of the team that runs the White House media operations. What does that tell us about the Democratic Party and the left?
